A. 
Except as provided in § 104-2 hereof, no person shall discharge any BB gun, air gun, rifle, shotgun, revolver, pistol or other firearm or make use of any sling or arrow within the Borough of Westmont.
B. 
No person shall, intentionally and without malice, point or aim a firearm at or toward another or discharge a firearm so pointed or aimed.
A. 
This section does not extend to cases in which firearms, slings or arrows are used in self-defense, in the discharge of official duty or in justifiable homicide.
B. 
This section does not extend to cases in which BB guns, air guns, slings or arrows are used for target practice under adult supervision and as approved by the Chief of Police, unless in such cases the target practice activity would create a hazardous and dangerous condition endangering the health, welfare and safety of the residents of the Borough of Westmont. Should this occur, the Chief of Police shall be empowered to immediately cause the cessation of such activity.
A. 
Whoever violates or fails to comply with the provisions of this chapter shall be fined not more than $600 plus costs of prosecution for each offense and, in default of payment of such fine and costs, imprisonment in the county jail for a term not exceeding 30 days. Unless otherwise provided, a separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues. The penalty provided for herein shall be in addition to any fee, deposit, charge, surcharge, interest, insurance or bond requirement or equitable remedy provided under authority of state law.[1]

B. 
Every person who commits or aids or abets in the commission of any act declared in this chapter to be an offense, whether individually or in connection with another person, or as principal, agent or accessory, shall be guilty of such offense. Every person who falsely, fraudulently, forcibly or willfully induces, causes, coerces, requires, permits or directs another to violate this chapter shall likewise be guilty of such offense.
