No person shall install, construct or request bid proposals for construction or alter an individual sewage system or community sewage system or construct or request bid proposals for construction or install or occupy any building or structure for which an individual sewage system or community sewage system is to be installed within the territorial limits of the Borough of Westmont, Cambria County, without first obtaining a permit from the Borough of Westmont indicating that the site and the plans and specifications of such system are in compliance with the provisions of the Pennsylvania Sewage Facilities Act of 1966, P.L. 1535, as amended,[1] and the rules and regulations adopted by the Department of Environmental Resources pursuant to the Act.

Applications for permits shall be made in writing on the form prescribed by the Department of Environmental Resources to any Sewage Enforcement Officer or officers employed by the Borough to administer the provisions of Section 7 of the Act.[1]

A. 
Application fees shall be made payable to the Borough of Westmont for an application for a conventional individual sewage system and for the alteration or repair of an existing sewage system, in amounts as shall be set forth from time to time by resolution of the Borough Council. Such fees shall be paid at the time of making application.
B. 
When an alternate sewage system is required by the Sewage Enforcement Officer or where a community sewer system is involved, the application fee shall be payable at the time of application, together with an additional fee at the rate per hour expended by the Sewage Enforcement Officer for additional services by him beyond those usual to applications for conventional sewage systems, in amounts as shall be set forth from time to time by resolution of the Borough Council. Such additional fee shall be paid at the time of completion of the installation and before the final inspection hereof.
The applicant at his own expense shall perform the following:
A. 
Prepare the soil test excavation.
B. 
Dig the soil log holes and percolation holes.
C. 
Presoak the test holes.
D. 
Provide water for percolation tests.
E. 
Provide for the services of a qualified consultant to prepare design plans where an alternate system is required.
F. 
Notify the Sewage Enforcement Officer of the readiness of the site for the initial site inspection and for the final inspection.
Where a permit for on-site sewage is required under the Act[1] before building operations can be commenced, no building permit shall be issued for building on the site until an on-site sewage permit is obtained pursuant to this article.

The Borough hereby incorporates by reference as part of this article the provisions of the Pennsylvania Sewage Facilities Act of 1966, P.L. 1535, as amended,[1] and the rules and regulations as thereunder adopted by the Department of Environmental Resources.

Any person who shall violate any of the provisions of this article or of the Act[1] or the rules, regulations or standards promulgated hereunder or who resists or interferes with any officer, agent or employee of the Borough in the performance of his duties shall, upon conviction thereof in a summary proceeding before any District Justice or Magistrate in Cambria County, be sentenced to pay a fine of not less than $100 and costs and not more than $300 and costs, to be paid to the County of Cambria, or, in default thereof, he shall be confined to the county jail for a period of not more than 30 days.
