The purpose of this article is to prohibit the feeding of unconfined
wildlife in any public park or on any other property owned or operated
by the Township of Marlboro, so as to protect public health, safety
and welfare, and to prescribe penalties for failure to comply. Additionally,
the purpose is to prohibit the feeding of wild deer anywhere in the
Township of Marlboro, including, without limitation, upon private
property so as to protect the public health, safety and welfare and
to prescribe penalties for failure to comply, subject to the provisions
of New Jersey P.L. 1999, Chapter 231.
As used in this article, the following terms
shall have the meanings indicated:
FEED
To give, place, expose, deposit, distribute or scatter any
edible material with the intention of feeding, attracting or enticing
wildlife. Feeding does not include baiting in the legal taking of
fish and/or game.
PERSON
Any individual, corporation, company, partnership, firm,
association or political subdivision of this state subject to municipal
jurisdiction.
WILDLIFE
All animals that are neither human or domesticated.

A. No person shall feed, in any public park or on any other property
owned or operated by the Township, any wildlife, excluding confined
wildlife (for example, wildlife confined in zoos, parks or rehabilitation
centers) and unconfined wildlife at environmental education centers,
subject to the provisions of New Jersey P.L. 1999, Chapter 231. Notwithstanding the above, the feeding of feral cats as
part of an approved neuter, track and release (TNR) program is allowed.
B. No person shall feed wild deer on any property within Township of
Marlboro, including publicly or privately owned property, without
limitation, except as provided for under the provisions of New Jersey
P.L. 1999, Chapter 231.
Any person who shall violate any provision of this article shall be subject to a minimum fine of not less than $50 for each and every violation and a maximum fine as provided in §
4-3 of the Code.
