§ 138-35 Applicability of Title 39, Subtitle 1, to certain premises.

In accordance with N.J.S.A. 39:5A-1 et seq., written requests having been filed with the Township pursuant thereto, the provisions of Title 39, Subtitle 1, of the New Jersey Revised Statutes are hereby applied to the semipublic or private roads and parking areas of the following described premises:

A. Central Jersey Bank.

B. Central Mall Shopping Center.

C. Marlboro Centre Shopping Center.

D. Marlboro Mall Shopping Center.

E. Marlboro Plaza Shopping Center.

F. Kilmer Park Professional Building.

G. Willow Pointe.

H. Union Hill Road Commuter Parking Lot.

I. The Orchards at Marlboro.

J. The Mart Center.

K. Pointe De Jardin.

L. Cambridge Square Shopping Plaza.

§ 138-36 General parking regulations.

Within any of the premises described in the schedules concerning parking, no person shall park a vehicle except within the stalls provided for parking and within the painted lines.

§ 138-37 Additional parking and traffic regulations.

A. Central Jersey Bank.

(1) The easterly most driveway from the Central Jersey Bank along Tennent Road is hereby designated as "exit only."

B. Central Mall. Central Jersey Bank and Trust has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at the Central Mall, located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide, as shown on the attached site plan,[1] and signed with R7-8 (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

(3) Parking time limited. No person shall park a vehicle for longer than the time limit between the hours listed on any day upon any of the streets or parts of streets described:

(4) Restricted parking. No person shall stop or stand a vehicle anytime upon any of the following described roadways or parts of roadways:

(5) Reserved parking. The parking lot has reserved parking for various vehicles, which must be properly identified as per the site plan.

(6) Tow-away zone. Any vehicle parked or standing so as to obstruct or impede a normal flow of traffic, block entrances, exitways, loading zones, oil fills, any grass area or pedestrian walkway or which presents in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.

(7) Weight limitations. Trucks over four tons' gross weight are hereby excluded from the main parking areas, except for the pickup and delivery of materials in those areas.

(8) One-way streets. The following described streets or parts of streets are hereby designated as one-way streets in the direction indicated. Parking on these streets will be permitted on the sides indicated.

(9) Through streets; stop intersections.

(a) Through streets. The following streets or parts of streets are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through streets.

(10) Speed limits.

(a) The speed limits for both directions of traffic in the parking lots and roadway lane shall be 15 miles per hour.

(b) The speed limits for both directions of travel on the following roads are:

(11) All signs, posts, bolts or other necessary materials shall be installed and paid for by the applicant. Work shall be checked by the Police Department to ensure installations meet state and federal specifications, and all signing shall conform to the current Manual on Uniform Traffic Control Devices.

(12) Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of this subsection or any supplement thereto shall be liable to a penalty of not more than $500 or imprisonment for a term not exceeding 15 days, or both.

C. Marlboro Centre. Dave Marion Corp. has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at Marlboro Centre, located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide, as shown on the attached site plan,[2] and signed with R7-8 (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

D. Marlboro Mall. Michael Manzo has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at Marlboro Mall, located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide, as shown on the attached site plan,[3] and signed with R7-8 (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

Kaufman and Basser Corp. has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at Marlboro Plaza Shopping Center, located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide, as shown on the attached site plan,[4] and signed with R7-8 (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

(13) All signs, posts, bolts or other necessary materials shall be installed and paid for by the applicant. Work shall be checked by the Police Department to ensure installations meet state and federal specifications, and all signing shall conform to the current Manual on Uniform Traffic Control Devices.

(14) Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of this subsection or any supplement thereto shall be liable to a penalty of not more than $500 or imprisonment for a term not exceeding 15 days, or both.[5]

F. Willow Pointe. Federal Equity Association II has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at Willow Pointe, located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide, as shown on the attached site plan,[6] and signed with R7-8 (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

The Township of Marlboro has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at the Union Hill Road Commuter Parking Lot, located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide, as shown on the attached site plan,[7] and signed with R7-8 (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

(11) One-way streets. The following described streets or parts of streets between the upper and lower parking lots are hereby designed as one-way streets in the direction indicated. Parking is prohibited on these streets.

Mc Cay Real Estate Group has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at Exclusive Plaza located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(5) Permit parking.[10]

(a) The parking lot has reserved parking for various vehicles which must be properly identified as per the site plan, and identification stickers must be displayed on the left rear window of each vehicle.

(b) All employees of Exclusive Plaza shall be issued parking permits by the owner. These permits shall be dated by year and displayed inside the left rear window. The stickers shall not be less than a two-inch square. These stickers shall be the responsibility of the owner, and a list shall be furnished to the Traffic and Safety Bureau at least twice a year. This list will include the registration, year, color, driver's information and sticker number. It shall be the owner's responsibility to collect any stickers from former employees.

(c) The following spaces shall be set aside for the Atlantic City concession. Special time-dated permits shall be issued daily by the owners of Exclusive Plaza or a designated representative. These permits shall be used for the following mentioned spaces only:

Samuel Associates has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at The Mart Center located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide as shown on the attached site plan[12] and signed with R7-8 (reserved parking sign and penalty plate), in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

Point De Jardin, Assoc., has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39, of the Revised Statutes of New Jersey shall be made applicable to the semipublic roads, streets, driveways and parking lots at Pointe De Jardin located in the Township of Marlboro, County of Monmouth, State of New Jersey, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide as shown on the attached site plan[13] and signed with R7-8 (reserved parking sign and penalty plate), in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

(3) Assigned parking.

(a) The parking areas have assigned parking consisting of one parking space per address.

L. Cambridge Square Shopping Plaza. Scott T. Loventhal of Union Hill Associates, L.L.C. has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at the Cambridge Square Shopping Plaza, located in the Township of Marlboro, County of Monmouth, and the following regulation shall be enforceable:

(1) All vehicles must park in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide as shown on the attached site plans and signed with the R7-8 and R7-8P (reserved parking sign and penalty plate), in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

(3) Parking time limited. No person shall park a vehicle for longer than three hours on any day upon the entire property, except the commuter lots.

(4) Restricted parking. No person shall stop or stand a vehicle anytime upon any of the following described streets or parts of streets:

(17) Effect of regulations. If any part of this regulation is for any reason held to be invalid, such decision shall not effect the validity of the remaining portion of the regulation.

M. Bear Brook Commons. Bear Brook Commons, Eric Rosenblum of the Heller Group has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at the Bear Brook Commons shopping center, located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park only in designated areas and between the lines provided.

(2) Handicapped parking. All stalls shall be 12 feet wide as shown on the attached site plans and signed with the R7-8 and R7-8P (reserved parking sign and penalty plate), in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

(3) Parking time limits. No person shall park a vehicle for longer than three hours on any day upon the entire property.

(4) Restricted parking. No person shall stop or stand a vehicle anytime upon any of the following described streets or parts of streets:

American Plaza, LLC, has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1, Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways, and parking lots at the Marlboro Costco shopping Center (Block 176 Lots 5.01, 5.02, 9-11) in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

(1) All vehicles must park in designated areas between the lines provided.

(2) Handicapped parking. Towle of Centex Homes, LLC has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at Huxley Court located in the Township of Marlboro, County of Monmouth, and that the following regulations shall be enforceable to said roads, streets, driveways and parking lots, thereby amending and supplementing Chapter 138, Vehicles and Traffic, of the Code of the Township of Marlboro:

Towle, Vice President, Centex Homes, LLC has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at Kensington Gate located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable to said roads, streets, driveways and parking lots, thereby amending and supplementing Chapter 138, Vehicles and Traffic, of the Code of the Township of Marlboro:

Candi Morey, Property Manager for the Mill Ponds Condominium Association, has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey to be made applicable to the semipublic roads, streets, driveways and parking lots at the Mill Ponds Development located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable:

Greenstein, representing Advantage Property Management, has filed a written consent with the Township of Marlboro that the provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at Orchards at Marlboro Condominiums located in the Township of Marlboro, County of Monmouth, and the following regulations shall be enforceable to said roads, streets, driveways and parking lots, thereby amending and supplementing Chapter 138, Vehicles and Traffic, of the Code of the Township of Marlboro:

T. Ambten Road Associates Site. Ambten Road Associates, LLC, as a condition of site plan approval, and pursuant to the Monmouth County Planning Board Site Plan Action under Docket No. MRSP8497, must prohibit left-hand turns into and out of its site which shall be enforceable as follows:

(1) There shall be no left-hand turns into or out of the site (i.e., right turns in and out only) located on Tennent Road between Amboy Road and Commercial Court, also known as Block 172, Lot 41, on the Official Tax Map of the Township of Marlboro, Monmouth County, New Jersey.
