The intent of this chapter is to add to and supplement the list
of Type II actions presently contained in 6 NYCRR 617.13, being the regulations adopted pursuant to the New York
State Environmental Quality Review Act.
In addition to those listed in 6 NYCRR 617 as Type II actions,
the following are deemed to be Type II actions. The following actions
or classes of actions have been determined not to have a significant
effect on the environment and do not require environmental impact
statements or any other determination or procedure under 6 NYCRR 617,
and the actions set forth on this list are no less protective of the
environment than the list in 6 NYCRR 617.13 and will in no case have a significant effect on the environment
based on the criteria contained in 6 NYCRR 617.11:
A. The construction or alteration of a single- or two-family residence
and accessory appurtenant uses or structures not in conjunction with
the construction or alteration of two or more such residences and
not otherwise described as a Type I action.
B. The construction or alteration of a store, office or restaurant designed
for an occupant load of 20 persons or fewer if not in conjunction
with the construction or alteration of two or more stores, offices
or restaurants and if not otherwise described as a Type I action and
the construction of utility facilities to serve such establishment.
C. The operation, repair, maintenance or minor alteration of existing
structures, land use and equipment.
D. An action to enforce any provision of the Code of the Town of Pompey.
E. Approval of a street opening permit for the purpose of tying into
existing utility facilities.
F. Approval of lateral connections to sewer or water lines.
G. Adoption or amendment of any local law when such adoption or amendment
is either required by or is an option granted by any state or federal
law.
H. Any action under Chapter
17, Defense and Indemnification, or Chapter
24, Code of Ethics.
I. Adoption of regulations or amendments to existing regulations related
solely to applications, review of applications or to fees charged
as part of the application process.
J. Enactment of or amendment to the procedure for enactment of local
laws or ordinances.
K. Adoption of legislation codifying existing laws.
L. Any action, including investigation, report, notice or decision, related to unsafe buildings pursuant to Chapter
69, Unsafe Buildings.
M. Any action related to the acceptance by the Town of an interest in
real property or of completed utility facilities therein.
