Real property located in the Town of Sodus owned by one or more persons, each of whom is 65 years of age or over, shall be exempt from taxation by the Town of Sodus for Town purposes to the extent of a percentage of the assessed valuation thereof, provided that the owner or owners meets or meet the following qualifications:
A.
The income of the owner or the combined income of the owners, and where title is vested in either the husband or the wife, their combined income, which income shall include social security and retirement benefits, interest, dividends, rental income, salary or earnings and income from self-employment, but shall not include gifts or inheritances, must not exceeded the scheduled amount for the 12 consecutive months immediately preceding the date of making application for exemption.

C.
Title to the property must have been vested in the owner or, if more than one, on all of the owners of the property for at least 24 consecutive months prior to the date of making application for exemption.
D.
The property must be used exclusively for residential purposes.
E.
The property must be the legal residence of and occupied in whole or in part by the owner or, if more than one owner, by all of the owners of the property.
