A. 
Application. The applicant for a junkyard permit shall obtain application forms from the Town Clerk. The completed forms, along with one copy of the proposed or existing site plan, and the appropriate fees, shall be returned to the Clerk. The Town Clerk shall submit the completed application materials to the Town Planning Board for its review. The Town Planning Board shall submit the application materials, along with its recommendations, to the Town Board within 60 days of receipt. The Town Board shall render its decision within 30 days thereafter.
B. 
Renewal. Application for annual renewal shall be submitted to the Town Clerk by April 1 of each year following initial issue. The completed forms along with one copy of a current site plan and appropriate fees shall be returned to the Town Clerk. The Town Clerk shall submit the application materials to the Town Planning Board. The Town Planning Board shall submit the application materials, along with its recommendations, to the Town Board within 60 days of receipt. The Town Board shall render its decision within 30 days thereafter.
The site plan shall be drawn to scale or indicate all dimensions and show:
A. 
All existing and proposed structures, including fences;
B. 
All property lines, including the names of legal owners of the property and all adjacent properties including Tax Map and parcel numbers;
C. 
All streams, lakes, wetlands, floodplains, and other water bodies;
D. 
All wells and sanitary facilities located on or within 500 feet of the site;
E. 
All roads and easements;
F. 
All existing and proposed junk storage areas;
G. 
All existing and proposed accessways, and parking and loading areas.

An environmental assessment form (EAF) (short form: Part 617.20, Appendix B) shall be completed and submitted with all applications pursuant to the provisions of the State Environmental Quality Review Act, 6 NYCRR 617. If the short EAF indicates that the proposed activity may have significant environmental consequences, the Town Board shall require that a full environmental assessment form (Part 617.20, Appendix A) be submitted with the application. The application shall not be considered complete until the Town Board has accepted an EAF.
A. 
Application fee. A nonrefundable application fee of $500 shall accompany all applications. This fee covers such costs as site visits by Town officials, one public notice in newspapers and one public hearing. The fee can be increased by resolution of the Town Board.
B. 
Renewal fee. A nonrefundable yearly renewal fee of $250 shall accompany all renewal applications. This fee covers such costs as site visits by Town officials and other administrative activities as may be necessary. The fee can be increased by resolution of the Town Board.
Any person maintaining a junkyard within the Town of Steuben shall present proof that he or she has in effect a general liability insurance policy which covers exposure created by the presence of a junkyard and provides a minimum coverage of $1,000,000.
The Town Board shall conduct a hearing within 60 days of the date a complete application is received by the Town Clerk. Notice of the hearing shall be made in the official newspaper at least 10 days prior to the date thereof. At the hearing, the Town Board shall hear the applicant and all other persons wishing to be heard on the application for a junkyard permit.
Within 45 days of said hearing, the Town Board shall render a decision to approve, approve with conditions, or to disapprove the application for a junkyard permit. The forty-five-day period may be extended by mutual consent of the applicant and the Town Board. All findings of the Town Board shall be entered into the Town Board minutes. The decision of the Town Board shall immediately be filed in the office of the Town Clerk and the applicant shall be notified of the decision and the reasons for such decision by certified mail within 10 days of the decision of the Board. Upon approval of the site plan and application and payment of all fees and reimbursable costs due the Town, the Town Board shall endorse its approval upon a copy of the final site plan and application.
A. 
If the application is approved by the Town Board, a junkyard permit shall be issued by the Town Clerk.
B. 
If the application is approved with conditions by the Town Board, the Town Clerk shall issue a junkyard permit upon notification by the Enforcement Officer that said conditions have been complied with.
