No person shall have in his possession any open bottle or container
containing liquor, beer, wine or other alcoholic beverage while such
person is on any public highway, public street, public sidewalks,
public parking area or in any vehicle or public place excepting those
premises duly licensed for the sale and consumption of alcoholic beverages
on the premises.
An open bottle or open container as above described in any vehicle
shall be presumptive evidence that the same is in possession of all
occupants thereof.
A violation of this chapter shall constitute an offense punishable
by a fine not exceeding $25 or by imprisonment for 10 days, or by
both such fine and imprisonment, for the first offense, and by a fine
not exceeding $50 or by imprisonment in jail for 30 days, or by both
such fine and imprisonment, for a second or subsequent offense.
