This article is enacted to comply with amendments by the State
of New York to § 107 of the Agriculture and Markets Law.
Consistent with those amendments, this article establishes procedures
and fees for the licensing of dogs in the Town of Stockport.
All dogs within the Town of Stockport four months of age or
older, unless exempted, shall be licensed. The owner of each dog required
to be licensed shall obtain, complete, and return to the Town Clerk
a dog license application together with the license application fee,
any applicable license surcharges and such additional fees as may
be established by the Town. Each license application shall be accompanied
by proof that the dog has been vaccinated against rabies or a statement
from a licensed veterinarian that such vaccination would endanger
the dog's life, in which case vaccination shall not be required.
Each license issued shall be valid for a period of one year and shall
not be transferable.
The Town authorizes the Columbia Greene Humane Society acting by its manager to provide, accept and grant an application for a dog license made by a resident of Stockport at the time of adoption of a dog from the Columbia Greene Humane Society, provided that such application is made in accordance with §
49-1.1 of this article and the license fee, any additional fee and surcharge shall be remitted to the Town Clerk of Stockport on or before the third day of the month following the month in which the license fee and additional fee and surcharge was received.
The Town Board of Stockport shall establish by resolution licensing
fees for the following categories of dogs pursuant to this article:
B. Unspayed or intact dogs. Such fee shall be at least $5 greater than
that for spayed or neutered dogs.
In addition to the license fees established by the Town Board,
each applicant for a dog license shall pay a surcharge of $1 if the
dog to be licensed is altered, or a fee of $3 if the dog sought to
be licensed is unaltered. This surcharge shall be remitted by the
Town of Stockport to the Department of Agriculture and Markets for
transmittal to the State Comptroller for deposit in the population
control fund.
The owner of any dog impounded by the Town of Stockport shall
be entitled to redeem that dog within five business days, excluding
the day the dog is impounded, provided that the owner produces proof
the dog is licensed and identifies and pays the then-current impoundment
fee charged by the animal shelter, which fee will be a minimum of
$10 for the first impoundment; a minimum of $20 for the second impoundment;
a minimum of $30 for a third and each subsequent impoundment together
with a fee of $3 for each additional twenty-four-hour period the dog
remains impounded.
This article is intended to supersede any inconsistent provisions
in the Stockport Town laws and repeals any previously enacted laws
pertaining to the licensing of dogs.
