A.
Any violation of any of the provisions of this chapter
shall constitute a "violation" as that term is defined in the New
York State Penal Law. Unless otherwise specifically provided by law,
this violation shall be punishable by a fine of not more than $250
or by imprisonment not exceeding fifteen days, or both. Where a continuing
violation exists, each day that such a violation continues shall be
considered a separate and distinct offense and shall be punishable
accordingly.
B.
The Attorney for the Town, at the request of the Town Board, may maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with these rules and regulations, to prosecute any violation of these rules and regulations, or to restrain by injunction any violation of these rules and regulations, in addition to and notwithstanding the provisions of Subsection A hereof for a penalty or other punishment.
C.
Where any violation of these rules and regulations
causes additional costs, damages, or expenses to the Town (including
but not limited to attorney fees), such violation may also be punished
by a civil suit against the violator, brought by the Attorney for
the Town in the name of the Town in a court of competent jurisdiction,
to recover such additional costs, damages, or expenses.
D.
The Town Board may maintain an action or proceeding in the name of
the Town in a court of competent jurisdiction to compel compliance
with or to restrain, by injunction, the violation of this chapter
or any regulation or order promulgated under this chapter.

E.
The Town Board may maintain an action or proceeding in the name of
the Town in a court of competent jurisdiction to obtain civil monetary
penalties in the amount of $250 for each violation for each day of
the violation.

F.
When a consumer is delinquent on its payment of its water use bill
for a period of 90 days or where a consumer has failed to make a required
improvement or repair, such as installation or repair of a water meter
or a water service line, the Town Board, after due notice to the consumer
and an opportunity to be heard, may discontinue water service to the
consumer. The Town may charge a fee for the resumption of service,
which fee may be established and amended from time to time by resolution
of the Town Board.

G.
No remedy or penalty specified in this section shall be the exclusive
remedy or penalty available to address any violation of this chapter
and each remedy or penalty specified in this section shall be in addition
to, and not a substitution for or limitation of, the other remedies
or penalties specified in this section.

H.
The requirements and provisions of this chapter may be administered
and enforced by any officer, employee or contractor designated by
resolution of the Town Board.
