Section 3-301 of the Village Law is hereby amended to read as follows:
  § 3-301 Village officers.
1.
The Village of Williston Park shall have the following officers:
a.
A Mayor;
b.
Four Trustees, except that the Board of Trustees of the Village of Williston Park may change the number of Trustees as authorized by § 3-304 of the Village Law;
c.
A Treasurer;
d.
A Village Clerk;
e.
A Secretary to the Board of Trustees;
f.
A Supervisor of Public Works;
g.
A Village Justice or Acting Village Justice; and
h.
A Village Attorney.
In the event of death, illness or incapacity of the Clerk or Treasurer, a Deputy Clerk or a Deputy Treasurer may be appointed as hereinafter provided.
2.
The Board of Trustees, by resolution or local law, subject to permissive referendum, may abolish the office of Village Justice, but such action shall take effect only upon the expiration of the then-current term of such office, or establish a second office of Village Justice, which Justice, once elected, shall have all the powers and duties of a Village Justice. A resolution or local law, in the latter case, shall provide for a term pursuant to § 3-302 of the Village Law.
3.
The Village of Williston Park may have the following officers:
a.
An Assessor or Assessors; provided, however, that the Board of Trustees, by resolution or local law, may consolidate the offices of Clerk, Treasurer and Assessor or any two of such offices. The Board of Trustees may also determine, by local law or resolution, that such Board of Trustees shall act as the Board of Assessors or may appoint such Board from its members.
b.
Such other officers, including deputies, as the Board of Trustees shall determine.
4.
The Mayor, Trustees and Village Justices shall be elective officers. All other officers shall be appointed by the Mayor, subject to the approval of the Board of Trustees.
5.
The Mayor and the Trustees of the Village of Williston Park shall constitute the Board of Trustees thereof.
6.
No person shall be disqualified from holding office in the Village of Williston Park by reason of the fact that he or she holds any other public office.

Section 4-402 of the Village Law is hereby amended to read as follows:
  § 4-402 Clerk; Deputy Clerk and Secretary.
1.
The Clerk of the Village of Williston Park, subject to the direction and control of the Mayor:
a.
Shall have custody of the Corporate Seal, books, records and papers of the village and all the official reports and communications of the Board of Trustees;
b.
Shall keep a record of all village resolutions and local laws;
c.
Shall prepare, sign and transmit to the Village Treasurer an order directing the Village Treasurer to pay the claims therein specified, which order shall contain an abstract of all claims audited and ordered paid by the Board of Trustees or other board having power to audit, showing the names of the claimants, the amounts approved for payment and the appropriations chargeable therewith. The Clerk shall keep an accurate account of all orders drawn on the Treasurer of the village, showing the persons to whom and the funds from which the amount of each order is to be paid, unless the Board of Trustees shall by resolution determine that such accounts shall be kept by an Auditor. Except as otherwise provided in § 1438 of the Real Property Tax Law, all money belonging to the village received by such Clerk in any month shall be paid to the Village Treasurer on or before the 10th day of the next succeeding month;
d.
Shall, during office hours as prescribed by the Board of Trustees, on demand of any person, produce for inspection the books, records and papers of his or her office and shall furnish a copy of any portion thereof, certified in the proper form to be read in evidence, upon payment of the fees therefor, at the rate of $0.20 per folio;
e.
Shall collect taxes and assessments of the village as provided in this act if the Board of Trustees shall, by resolution, determine that the taxes and assessments of the village shall be collected by the Clerk;
f.
Shall keep an indexed record of all written notices which he or she shall receive of the existence of a defective, unsafe, dangerous or obstructed condition in or upon, or of an accumulation of ice or snow upon, any village street, highway, bridge, culvert, sidewalk or crosswalk, which record shall state the date of receipt of the notice, the nature and location of the condition stated to exist and the name and address of the person from whom the notice is received. The Clerk shall, at the Board meeting next following receipt of such written notice by him or her or within 10 days, whichever is sooner, cause said written notice to be brought to the attention of the Board of Trustees. The record of each notice shall be preserved for a period of five years after the date it is received.
g.
May administer the oath of office to all village officers;
h.
Shall also perform such other duties not inconsistent with his or her office as shall be determined by resolution of the Board of Trustees.
2.
Deputy Clerk. The Board of Trustees, by resolution duly adopted, may authorize the Clerk to appoint one or more deputies. Each Deputy Clerk shall receive an annual compensation to be fixed by the Board of Trustees and shall perform such official duties as may be assigned to him or her by the Clerk. In the case of the absence or disability of the Clerk, the Deputy Clerk or Clerks shall perform all of the duties of the Clerk as the Board of Trustees shall direct.

The Secretary to the Board of Trustees shall act as the Clerk of the Board of Trustees and of each board of village officers and shall keep a record of their proceedings. The Secretary shall take minutes of such proceedings, transcribe such minutes, have them available for the next regular meeting of the Board of Trustees and, upon their approval and adoption, deliver them to the Clerk for safekeeping as a part of the records of the village and shall otherwise perform the legislative and election duties assigned to the Clerk either by law or by resolution of the Board of Trustees.

A. 
The term of office of the Mayor and each Trustee and of the Village Justice shall be four official years. The term of office of the Treasurer and the Clerk shall be two official years.
B. 
The general village election shall be held biennially in even-numbered years.
C. 
Notwithstanding the provisions of Subsection B, with respect to the two Trustee offices whose terms of office shall expire on April 1, 1985, the new terms of the offices of the Trustees commencing April 1, 1985, shall be for three years, and, upon expiration of such three years, each official term of office thereafter shall be four years.

A. 
Position established. Pursuant to § 3-301, Subdivision 3b of the Village Law of the State of New York, as amended by § 40-1 of this chapter, the position of Village Administrator of the Village of Williston Park is hereby established, and, unless otherwise provided by resolution of the Board of Trustees, the Village Clerk-Treasurer shall be the Village Administrator and shall serve in such capacity at the pleasure of the Board of Trustees.[1]

B. 
Powers and duties. Subject to the direction, control and approval of the Mayor and Board of Trustees, the Village Administrator shall:
(1) 
See that all laws applicable to the village and its officers and employees and all ordinances, resolutions, rules and regulations of the village are faithfully executed and enforced.
(2) 
Supervise and direct all functions and activities of the village and of its officers and employees, except the Village Justice, Village Attorney and Board of Appeals.
(3) 
Make reports to the Mayor and Board of Trustees on the affairs of the village and recommend to them such measures as he or she may deem necessary or appropriate for the purpose of obtaining greater efficiency and economy in the government and operation of the village.
(4) 
Exercise general supervision over all expenditures of the village in accordance with the budget and keep the Board of Trustees fully advised of the financial condition of the village and its future needs.
(5) 
Prepare annually a tentative budget for consideration by the Board of Trustees and serve as budget officer when so designated by the Mayor in accordance with § 5-500 of the Village Law.
(6) 
Have such other powers and duties, not inconsistent with law, as from time to time the Board of Trustees may by resolution determine.
