A.
No person
shall create any unreasonably loud, disturbing or unnecessary noise
in the Village of Yorkville, or allow or permit the creation of such
noise upon premises owned or occupied by such person, between the
hours of 9:00 p.m. and 7:00 a.m.

B.
No person
shall create a noise in the Village of Yorkville of such character,
intensity or duration as to endanger public health, peace or repose
or as to be detrimental to the life or health of any individual or
allow or permit the creation of such noise upon premises owned or
occupied by such person.
A.
No person shall use or operate or cause to be used
or operated any sound-amplifying device upon any public street or
place without the permission of the Police Department officer in charge.
B.
No permit shall be refused by the Police Department
officer in charge unless there is substantial and convincing evidence
that the use of such a sound-amplifying device would result in unreasonable
interference with the rights of others or unreasonably interfere with
the peace and quiet of those on private property or using public streets
and places.
C.
Any permit shall prohibit the use of such devices between the hours of 9:00 p.m. and 8:00 a.m. in all areas designated residential on the Zoning Map which is part of Ch. 135, Zoning, of the Code of the Village of Yorkville.
D.
Any permit may be suspended by the Police Department officer in charge or the Village Board of Trustees upon determination that the holder of the permit has violated any of the provisions of Subsections B or C of this section until the next regular meeting of the Board of Trustees, at which time the holder may present any statement or evidence in his behalf, and thereafter the Board of Trustees, by a majority vote, shall revoke, cancel or reinstate the permit. In the event that the holder of the permit does not appear at said meeting, either in person or by his representative, the permit shall be automatically revoked.
No person shall conduct any repair work on or
testing of vehicles or machines which causes any loud or raucous noise
anywhere in the Village of Yorkville between the hours of 8:00 p.m.
and 8:00 a.m.
A.
No person shall operate or play any radio, phonograph,
tape recorder, television set or any musical instrument, amplified
or nonamplified, repair or test any motor vehicle, however powered
or fueled, operate any motor vehicle with an improper muffler system,
or operate any snowmobile, go-cart, minibike or all-terrain vehicle
or other recreational vehicle or device powered by an internal combustion
engine in such a manner or in such volume at any time as to unreasonably
interfere with the peace, quiet, comfort or repose of any person in
any dwelling or other type of residence.

B.
No person shall conduct pool parties or other gatherings
of people whereby loud, raucous or boisterous noises are emitted so
as to unreasonably interfere with the peace, quiet, comfort or repose
of any person in any dwelling or other type of residence between the
hours of 9:00 p.m. and 8:00 a.m.

All engine-powered or motor-powered equipment intended for infrequent
service use in inhabited areas, typically requiring commercial or
skilled operators, shall not be operated between the hours of 9:00
p.m. and 7:00 a.m. Examples of commercial service equipment include
but are not limited to chain saws, log chippers, paving rollers, commercial
lawn mowers, leaf blowers, etc.

Any powered device or equipment designed and intended for use
in construction shall not be operated between the hours of 9:00 p.m.
and 7:00 a.m. Examples of construction devices include but are not
limited to air compressors, bulldozers, dump trucks, backhoes, trucks,
shovels, derricks, cranes, etc.

Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be punishable as provided in Article II, General Penalty, of Chapter 1, General Provisions. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
