The provisions of this article shall apply except
when it is necessary to stop a vehicle to avoid conflict with other
traffic or in compliance with the directions of a police officer or
official traffic control device.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XII (§
127-44), attached to and made a part of this chapter.
No person shall park a vehicle upon any street
in the Village between the hours of 2:00 a.m. and 7:00 a.m. throughout
the year.

All-night parking. Notwithstanding §
127-16 contained within this Village of Yorkville chapter, parking shall be allowed on Village streets between the hours of 2:00 a.m. and 7:00 a.m. upon receipt of a permit issued by the Village Clerk with the approval of the Chief of Police or officer in charge. Permits may be issued to allow passenger motor vehicles to be parked on the street all night. These permits may be issued only upon compliance with all the following conditions:
A. There must be no reasonable alternative to provide off-street parking
for the applicants. The granting of a permit shall be done only to
relieve a clearly demonstratable hardship and not in the nature of
a privilege and shall apply to residential properties only.
B. The parking area will be contiguous to the property for which the
permit is issued. The permit will not be valid in any other location.
Parking may be limited to one side of the street if, in the discretion
of the Chief of Police or officer in charge, it is in the public's
best interest to do so.
C. Only registered vehicles bearing current registration plates may
be parked in the parking area.
D. The permit holder must still follow all snow removal emergency regulations
and parking regulations other than prohibited all-night parking.
E. Only passenger motor vehicles and light trucks with a maximum load
capacity of one ton or less shall be eligible for a permit.
F. The permittee shall release, defend, indemnify, and hold harmless
the Village of Yorkville, its agents and employees from any claims
for personal injury or property damage arsing from the use of the
parking area, including damage allegedly caused by Village snow removal
and street cleaning operations.
G. Applications shall be made on a form to be determined by the Chief
of Police or officer in charge or, if there is none, the person designated
by the Mayor by the resident of the property contiguous to the proposed
parking area. Upon receipt of the application, the premises shall
be examined for the compliance with the conditions set forth herein.
All applications shall be forwarded to the Chief of Police or officer
in charge and the Chief of the Fire Department for review and comment.
If satisfied that all requirements have been fulfilled, the Village
Clerk shall issue the permit.
H. The permit shall have a number which will coincide with the name
and address for which it is authorized to be used and shall be in
the form of a permanent sticker affixed to the driver's side window.
The sticker must always be visible when the vehicle is parked on the
streets during the hours of 2:00 a.m. and 7:00 a.m.
I. The application fee for the permit shall be $125 due and payable
at the time the application is made and is not refundable. The fee
for a replacement certificate is $25.
J. The permit shall be valid for one year from the first day of January
to the last day of December and as long as the permittee resides at
the location and is in compliance with all conditions of this section,
whichever time period is shorter. All applications for renewal of
a permit shall be made by the Chief of Police or the officer in charge
or, if there be none, the person designated by the Mayor. If it is
determined that a substantial condition of the permit has not been
complied with, the Chief of Police or officer in charge or, if there
be none, the person designated by the Mayor may revoke the permit
after the permittee has had an opportunity for a hearing.
No person shall stop a vehicle upon any of the streets or parts of streets described in Schedule XIII (§
127-45), attached to and made a part of this chapter.
No person shall stand a vehicle upon any of the streets or parts of streets described in Schedule XIV (§
127-46), attached to and made a part of this chapter.
No person shall park a vehicle between the hours specified in Schedule XV (§
127-47) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XV, attached to and made a part of this chapter.
No person shall stop a vehicle during the times specified in Schedule XVI (§
127-48) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVI, attached to and made a part of this chapter.
No person shall stand a vehicle during the times specified in Schedule XVII (§
127-49) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVII, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule XVIII (§
127-50) at any time between the hours listed in said Schedule XVIII of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVIII, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XIX (§
127-51) except at the angle designated and only within the painted stall lines. On all streets or portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb.
The locations described in Schedule XX (§
127-52), attached to and made a part of this chapter, are hereby designated as loading zones.
The locations described in Schedule XXI (§
127-53), attached to and made a part of this chapter, are hereby designated as taxi stands.
The locations described in Schedule XXII (§
127-54), attached to and made a part of this chapter, are hereby designated as bus stops.
No person shall park a vehicle upon any of the streets or parts of streets described in Schedule XXIII (§
127-55), attached to and made a part of this chapter, during the period beginning from January 1 to April 1 of each year.
