[Amended 8-26-2002 by Ord. No. 4-2002; 12-14-2009 by Ord. No. 12.14.2009]
A.
Motor vehicles weighing 9,000 pounds or more are permitted to be parked on the streets and alleys of Jersey Shore Borough in one fixed location for a maximum period of time not to exceed 72 continuous hours.
B.
Motor vehicles weighing less than 9,000 pounds may be parked on Borough streets and alleys for a period not to exceed seven consecutive days.
C.
For purposes of this section, the term "motor vehicle" shall be defined by the Pennsylvania Vehicle Code (75 Pa.C.S.A. § 102) or any amendment thereto and is currently defined as follows:
MOTOR VEHICLE
A vehicle which is self-propelled, except an electric personal assistive mobility device or a vehicle which is propelled solely by human power.
D.
Parking on Borough streets and alleys is specifically and entirely prohibited if what is being parked is not a motor vehicle as defined under 75 Pa.C.S.A. § 102 or any amendments thereto.
E.
In the event that the provisions of this section shall conflict with the provisions of any other section of the Code of Ordinances of the Borough of Jersey Shore pertaining to parking (such as § 284-36), the more restrictive provision shall apply.
[Added 8-26-2002 by Ord. No. 4-2002]
A.
No person shall place nor cause to be placed any dumpster or any other object that is not a motor vehicle or a vehicle on any street or alley within the Borough of Jersey Shore for any purpose without first securing a permit from the Borough. Application for the permit shall be in writing and signed by some person duly authorized to act for the person who owns the dumpster or other object.
B.
The permit required by Subsection A shall be issued by the Borough Manager or his authorized agent only upon the following conditions:
(1)
A permit to place a dumpster or other object that is not a motor vehicle or a vehicle on a street or alley may only be issued upon a finding by the Borough Manager that it is not reasonably practicable to place such dumpster or other object on private property;
(2)
The location must be approved by the Chief of Police and by the Borough Manager;
(3)
The applicant must contract, in writing, on a form to be provided by the Borough, to comply with the terms of all Borough ordinances pertinent to the placement of such dumpster or object, and to defend and indemnify the Borough with regard to any claims, demands or actions which may be asserted or instituted against the Borough arising as a result of any property damage, property loss or destruction, personal injury, or death which may arise, in whole or in part, as a result of the placement of such dumpster or object; and
(4)
The applicant must pay the permit issuance fee in the amount of $10.
C.
At all times during which such dumpster or other object is present on such street, the dumpster or other object must display no fewer than two reflective devices on each of the four sides and must be surrounded by orange traffic cones. From the period of sunset to sunrise, the dumpster or other object must be surrounded on all four sides by lighted lanterns of red or amber glass or lighted flares. Except when actually being filled, any dumpster must at all times be covered with a lid, tarp or other device. Any permit issued pursuant to this section shall be valid for a period of 48 hours, unless the Borough Manager determines and expressly provides on the face of the permit that the permit shall be valid for such longer or shorter period of time as is in the opinion of the Borough Manager appropriate. The Borough Manager shall have the authority to extend the period of validity of any permit upon request of the applicant and upon a finding by the Borough Manager that such extension is necessary in order to accomplish the purpose for which the permit was initially issued and that the need for the extension is not caused by either neglect or intentional delay by the applicant or by his contractor.
D.
The Borough reserves the right to remove any dumpster or other object from any street upon failure of the applicant to do so in a timely manner or at any time if in the opinion of the Borough Manager the continued placement of such dumpster or other object is in violation of any ordinance of the Borough of Jersey Shore or creates a dangerous condition.
