The Council shall appoint a City Clerk for a term of four years. Prior to his or her appointment, he or she shall have been qualified by training and experience to perform the duties of his or her office. He or she shall serve as Clerk of the Council and have such other functions, powers and duties as are provided by this Charter.
The Clerk shall:
A. 
Keep the minutes and records of the proceedings of the Council, and of the proceedings of any Council committee upon request of the chairman of the committee;
B. 
Preserve and compile all ordinances and resolutions; and at the close of each year, with the advice and assistance of the City Attorney, the Clerk shall compile, codify and bind all the ordinances and resolutions then in effect, and shall properly index such compilation or codification and provide for its publication;
C. 
Have custody of the City Seal, and affix it to such books, papers and documents as may be authorized pursuant to law;
D. 
Have and take custody of all official books, papers and documents of the City for which no other repository is provided by Charter or ordinance; and preserve and keep them safely;
E. 
Provide secretarial and clerical services for the Councilmen in the discharge of their official duties;
F. 
Subject to the provisions of the Civil Service Law, appoint and remove subordinate officers and employees within his or her department;
G. 
Direct and supervise the work of the department and its employees through the divisions established by or under the Charter;
H. 
Assign functions, powers and duties to subordinate officers and employees within the department and modify such assignments as need appears;
I. 
Delegate to division heads such of his or her powers as he or she may deem necessary for efficient administration.
The City Clerk shall administer and countersign licenses and permits as provided by local law or ordinance. The Department of Public Safety shall cooperate in the enforcement of regulations and supervision of licensees pursuant to law.

The Clerk also shall:
A. 
Perform all of the functions required of municipal clerks by the Election Law and any other law or ordinance and receive for City use the fees prescribed therefor.
B. 
(1) 
Perform all the functions and duties of the Registrar of Vital Statistics for the City of Lackawanna, including, but not limited to, those functions and duties as contained in § 4120 et seq. of the Public Health Law of the Laws of the State of New York, as said sections are now constituted or shall hereafter be amended.
(2) 
That the above duties as contained in Subdivision B(1), supra, shall be performed at no additional compensation.
C. 
Have such other, different and additional functions, powers and duties as may be prescribed by law or ordinance.
