Pursuant to the provisions of N.J.S.A. 17:36-8 et seq., no insurance company authorized to issue fire insurance policies in the State of New Jersey shall pay any claims in excess of $2,500 on any real property located within the City of Vineland unless or until the insured person submits to such company an official certificate of search for municipal liens pursuant to N.J.S.A. 54:5-12, certifying that all taxes, assessments or other municipal liens or charges levied and assessed and due and payable against such property have been paid, or unless or until the City of Vineland submits to such company a certified copy of a resolution adopted pursuant to § 362-4 of this chapter. Search fees shall be paid by the insured.
The provisions of this chapter shall be applicable
to any fire insurance policy issued or renewed after the effective
date hereof and after the filing of this chapter with the State Commissioner
of Insurance.
With respect to fire damage claims in excess
of $2,500 on any real property located in the City of Vineland, the
company to whom such claim is submitted is hereby authorized and required,
pursuant to N.J.S.A. 17:36-9, to pay to the City of Vineland the amount
of the liens appearing on the official certificate of search for municipal
liens prepared pursuant to N.J.S.A. 54:5-12 and such other recorded
liens or related charges as may be certified to such company.
In the event that an agreement is entered into between the City of Vineland and the owner of a fire-damaged property for payment of delinquent taxes, assessments and/or municipal charges by installment payments pursuant to Article VII of Chapter 5 of Title 54 of the New Jersey Statutes Annotated, the involved insurance company, on receipt from the City of Vineland of a certified copy of a resolution of agreement to such effect, may make full payment on the claim to its insured.
Nothing herein shall be construed to alter or
affect any other remedy available to the City of Vineland under any
other law of the State of New Jersey.
