The Board of Supervisors of Lancaster Township finds and declares that
the provisions of this chapter are enacted to establish regulations regarding
the operation of skateboards, scooters and rollerblades on the highways, streets,
roadways, sidewalks, public parks, school yards, paths or other public places
within Lancaster Township, Lancaster County, Pennsylvania.
Unless otherwise indicated, all provisions of this chapter shall apply
to all skateboards, scooters and rollerblades, as herein defined, operated
or controlled within the jurisdictional boundaries of Lancaster Township.
As used in this chapter, the following terms shall have the following
meanings:
ROADWAY
That portion of the highway designed or ordinarily used for vehicular
travel, excluding sidewalks.
ROLLERBLADES
Shoes or boots affixed to two plastic or other synthetic material
wheels used to glide or skate over surfaces.
SCOOTER
A single platform mounted upon two plastic or other synthetic material
wheels which is propelled solely by human power and which has a single bar
steering device with which to control the movement or direction of the scooter.
SIDEWALK
That portion of the highway designated or ordinarily used for pedestrian
travel.
SKATEBOARD
A single platform mounted on metal, rubber, plastic or other synthetic
material wheels, which is propelled solely by human power and which has no
mechanisms or other device with which to steer or to control the movement
or direction of the platform.
VEHICULAR TRAFFIC
Traffic generated by every device, excluding skateboards, scooters,
rollerblades, wagons, wheelchairs, unicycles, pushcarts, tricycles, and other
children's toys, by which any person or property is or may be transported
or drawn upon a highway, street, roadway or sidewalk.
The Chief of Police or his/her designee is authorized to establish all
written regulations necessary to implement this chapter's provisions,
including regulations on posting of signs on private or public property where
the riding of skateboards, scooters or use of rollerblades shall be prohibited.
No person shall operate a skateboard or scooter or use rollerblades
on any highway, street, roadway or public alley in Lancaster Township in violation
of any traffic ordinance of Lancaster Township or the law of the Commonwealth
of Pennsylvania.
Every person convicted of violation of any provision of this chapter
shall be punished by a fine of not more than $50 and shall be ordered to pay
restitution should any damage or injury have resulted from the act giving
rise to the violation of this chapter.
