A certain document, three copies of which are on file in the office of the Secretary of the Borough of Milton, being marked and designated as the 1996 BOCA National Building Code, as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Building Code of the Borough of Milton, in the Commonwealth of Pennsylvania, for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of the 1996 BOCA National Building Code are hereby referred to, adopted and made a part hereof, as if fully set out in this article, with the additions, deletions and changes, if any, prescribed in §
103-10 of this article.

The following amendments, deletions and additions
shall be made to the Building Code:
A. Sections 112.0 and 112.3.1 of the Building Code of
the Borough of Milton are hereby amended by replacing the existing
fee schedule for building permits issued thereunder with the following
fee schedule for building permits:

For each increase of $5,000 or portion thereof
in excess of $10,0001.01, an additional permit fee of the lesser of
1% or $30 shall be charged. Permit fees will be doubled for work started
prior to application for permits.

A. Any person, partnership or corporation who or which
shall violate any provision of this article shall, upon conviction
thereof in a summary proceeding, be sentenced to pay a fine of not
more than $1,000, plus costs of prosecution, and, in default of payment
of such fine and costs, which persons, the members of such partnership
or the officers of such corporation shall be subject to imprisonment
for a period not in excess of 30 days. Each day that a violation continues
shall constitute a separate offense. All fines collected for violation
of this article shall be paid over to the Borough of Milton.
B. In addition to the remedies and penalties provided
in this article, the Borough of Milton may institute any appropriate
action in law or in equity to prevent, restrain, correct or abate
any action, conduct or condition which constitutes a violation of
this article.
