As used in this article, the following terms
shall have the meanings indicated:
RECREATION PLACES
Includes all parks, playgrounds and recreation places now
or hereafter owned or maintained by the Borough of Milton, Pennsylvania,
or operated by its Recreation Board.
The rules and regulations herein set forth apply
to all said recreation places.

A. Permit
required. Any individual or group seeking to secure exclusive use
of a recreation facility within the Borough of Milton for a specified
date and activity may do so by submitting a signed written request
which includes the name of the individual or group, address and phone
number of the contact person and the date, time and planned activity
of the event. Such request may be submitted either in person or by
mail or fax to the Borough of Milton, to the Borough Office, 2 Filbert
Street, Milton, PA 17847. The Borough of Milton may require a fee
for use, which shall be specified and adopted by resolution of the
Milton Borough Council, as it deems appropriate. If a fee is required,
it shall be payable to the Borough of Milton and be included with
the written request. The applicant shall receive approval either verbally
or in writing if so requested by the applicant. No activity will be
permitted which is in violation of the ordinances of the Borough of
Milton or other county, state or federal regulations.
B. Liability
insurance coverage. Any person or persons desiring to obtain a permit
for the use of a recreation facility or any type of athletic contest,
sporting event or event open to the general public shall also provide
to the Borough of Milton, with the request for use, a certificate
of insurance for public liability in an amount to be specified and
adopted by resolution of the Milton Borough Council.
C. Casual use. Any individual or group may use the recreation facilities of the Borough of Milton for personal casual use, provided that such use does not conflict with an already scheduled and permitted activity or involve the use of areas or facilities otherwise designated, maintained and specified for use by or for a designated group or activity only or violates any ordinance of the Borough of Milton or any county, state or federal regulations. Any person or persons reported to be interfering with scheduled and permitted use of a recreation facility will be in violation of this section and upon notification of such violation by the Milton Police Department, the Code Enforcement Officer, the Borough Manager, the Public Works Department or other authorized or designated representative of the Borough of Milton, shall immediately cease such interference or be subject to a fine as specified in the violation and penalty section of this article, and specifically §
169-10, and other penalties as provided by the Milton Borough Code or county, state or federal regulation.

The hours of operation for all recreation places,
as defined in this article or any related ordinance, shall be from
dawn to dusk. After dusk and prior to dawn, all recreation places
shall be closed. In order to utilize any recreational place after
dusk or prior to dawn requires special permission from Borough Council.
Such special permission must be obtained in advance through the submission
of a recreational usage form to be reviewed and approved by Borough
Council. Any person found within such recreation places during the
hours when they shall be closed, as herein provided, shall be guilty
of a violation of this article and, upon conviction thereof, shall
be subject to the penalties herein provided.
Driving or parking of automobiles and any other
motor vehicles shall be permitted only on roadways designated for
vehicular traffic within said recreation places, unless otherwise
directed by the police of the Borough of Milton.
No person shall commit any of the following
acts within any of said recreation places:
A. Commit any disorderly or immoral act.
B. Be intoxicated or drink any alcoholic beverages.
C. Throw stones or missiles.
D. Hit or drive a golf ball.
E. Publicly solicit subscriptions.
F. Throw, deposit or drain any offensive substance of
any kind or deposit paper, fruit, refuse, lunch baskets or other refuse
in any place save in receptacles provided therefor.
G. Sleep on the ground or elsewhere, except in such places
and at such times which may be designated by the Borough Council.
H. Utter loud, profane, offensive or indecent language.
No person shall commit any of the following
acts within any of said recreation places, without having previously
obtained the consent and approval of the Park Committee of the Borough
of Milton, Pennsylvania:
A. In any manner pull, injure or break any flower, fruit,
plant, tree, grass, turf, pump or water fixtures or any other structures.
B. Write, paint or carve on any tree, bench or other
structure.
C. Carry or discharge any firearms, air rifles, air pistols,
slingshots or fireworks, except that a person shall be permitted to
discharge a gun or other firearm within the recreational areas solely
for the purpose of lawfully shooting game animals, including crows,
provided that such activity occurs during such times and places and
in compliance with conditions established by the Milton Borough Council
pursuant to a resolution of the Milton Borough Council. Permits for
such activity shall be issued by the Police Department of the Borough
of Milton and shall contain such conditions as are established by
resolution of the Milton Borough Council.

D. Ride or drive any animal or vehicle at a speed exceeding
15 miles per hour.
E. Obstruct in any way any roadway or path.
F. Pick or carry any flowers or shrubs or carry any ax,
saw, picks, shovels or spades.
H. Post or display any sign, banner or advertisement
of a political or commercial nature.
I. Build any fire other than the places provided therefor.
J. Injure or unnecessarily destroy any wildlife.
K. Violate the regulations relating to the use of any
building or place.
L. Deface or mutilate any notice posted by order of said
Borough.
M. Enter or leave any recreation place by motor vehicle
except at the established ways of entrance and exit.

Any person or persons violating any provision
of this article shall, upon conviction thereof, be sentenced to pay
a fine of not more than $600, plus costs of prosecution, and, in default
of payment of such fine and costs, to imprisonment for not more than
30 days, provided that in any instance where a violation of any of
said rules and regulations also constitutes a violation of any provision
in any of the laws of Pennsylvania, such violation shall be prosecuted
under such law and not under this article.
