As used in this article, the following terms
shall have the meanings indicated:
CONTRACTOR OR VENDOR
Any person firm or corporation who has furnished or seeks
to furnish goods, supplies, services or lease space or has performed
or seeks to perform construction activity under contract, subcontract,
grant or loan with the
FINANCIAL LIABILITY
Any tax, including earned income tax, City real estate tax,
licenses, fees, delinquent loans, which shall be communicated to the
contractor or vendor promptly when due or payable.
OFFSET
The City may reduce any sums due or owing to the contractor
or vendor for any services above defined against any money that said
contractor or vendor shall owe to the City.
SUSPENSION
The City may disengage a contractual relationship with any
contractor or vendor who willfully refuses to comply with the terms
and conditions set forth in this article or is unable by offset to
satisfy any and all financial obligations owed to the City from any
monies owed by the City to the contractor or vendor. The contractor
or vendor may be reinstated upon proof that all sums due and owing
to the City have been met upon demand or upon offset.
Henceforth, no contractor or vendor doing business
with the City may be in financial liability to the City beyond the
City's notice to said contractor or vendor that said contractor or
vendor is in default of its obligations as hereinbefore defined.
Upon notice to the contractor or vendor of its
financial liability to the City, the City may offset any sums owed
by the City to said contractor or vendor to satisfy in full or in
part the contractor or vendors financial liability to the City.
