Because of the dangers inherent with smoking cigarettes, cigars and
pipes and the dangers that have been associated with the by-product of secondhand
smoke, the Council of the City of Monessen has deemed it to be in the public
interest to ban all such smoking from buildings within the care, custody and
control of the City of Monessen.
No person shall be permitted to smoke cigarettes, cigars, pipes or other
tobacco-related products within buildings that are in the care, custody and
control of any building or part thereof, including but not limited to offices,
conference rooms, hallways, basements or any other part thereof within those
buildings that are in the exclusive care, custody and control of the City
of Monessen.
Any person who violates the provisions of this chapter shall, upon conviction
thereof in a summary proceeding before any District Justice having jurisdiction
of such offense, be sentenced to pay a fine of not more than $300 or to undergo
imprisonment not exceeding 90 days, or both.
