All sidewalks, outdoor stairs, driveways, parking
spaces and similar areas shall be kept in a proper state of repair
and maintained free from hazardous conditions. For the purposes of
this article, "hazardous conditions" shall include snow, ice and other
debris which presents a danger to those traversing the above-mentioned
sidewalks, outdoor stairs, driveways, parking spaces and similar areas.
Such hazardous substance must be removed within 24 hours after the
appearance of such hazardous substance on the sidewalk, outdoor stairs,
driveway, parking spaces and similar areas. In the case of snow, the
twenty-four-hour period shall begin at the conclusion of the last
snowfall.
From and after the effective date of this article,
as amended, it shall be unlawful for any individual or corporation,
as owner, agent, lessee, tenant or employee of land and buildings,
whether business or residential, in the City to shovel or otherwise
deposit snow and/or ice from the premises back into the streets after
the same shall have been snowplowed, salted, cindered or otherwise
winterized.
It shall be the duty of the Office of Code Enforcement
of the City of Monessen to enforce the provisions of this article
and to issue citations for violations thereof.
Any person, firm or corporation, either as owner,
lessee, tenant, employee or duly authorized agent, who violates any
provision of this article shall, upon conviction thereof in a summary
proceeding before any Magisterial District Justice having jurisdiction
over such offense, be sentenced to pay a fine of not less than $25
and not more than $300, plus costs, or to undergo imprisonment not
exceeding 90 days, or both.
