As used in this article, the following terms shall have the meanings indicated:
FIRE OFFICIAL
The Fire Chief of any volunteer fire company providing fire protection service to the Township of Nockamixon, or the duly commissioned District Superintendent of the Palisades School District.
SMOKING
Includes possession of a lighted cigarette, cigar, pipe or other lighted smoking instrument.
TOBACCO USE
Includes smoking and the use of smokeless tobacco or tobacco products in any form.
Smoking and tobacco use in any form by any person is prohibited in the areas herein provided.
Smoking and tobacco use shall be prohibited in all public school buildings, on all public school property and in all public school buses within Nockamixon Township.
A. 
"No Smoking" signs. The Fire Official is empowered and authorized to order the owner or occupant to post "No Smoking" signs in each building, structure, room or place in which smoking and tobacco use is prohibited hereby. The content, lettering, size, color and location of required "No Smoking" signs shall be subject to the approval of the Fire Official.
B. 
Removal of signs prohibited. It shall be unlawful for any person to obscure, remove, deface, mutilate or destroy posted "No Smoking" signs.
Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 30 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
This article shall be enforced by the Palisades School Administrator, deputized school police or other person designated by the Palisades School Administrator.
