[HISTORY: Adopted by the Borough Council of the Borough of Prospect Park 10-13-1937 as Ord. No. 510, approved 10-13-1937. Amendments noted where applicable.]
The Borough of Prospect Park does hereby signify intention to organize an Authority, together with the Townships of Springfield, Ridley and Nether Providence and the Boroughs of Swarthmore, Rutledge, Morton and Ridley Park, under the provisions of the Acts of Assembly and the amendments and supplements thereto.[1]

Editor's Note: The joinder of the Township of Marple as a member of the Central Delaware County Authority was approved 9-14-1960 by Ord. No. 772. That ordinance also approved and set forth the form of application of said township to become a member, revised the terms of office of the members of the Board of the Authority and authorized the execution of said application.
The proper officers are hereby authorized and directed to organize the said Authority in conjunction with the proper officers of the aforesaid townships and boroughs and, together with the aforesaid officers, to execute the Articles of Incorporation and to file the same with the Secretary of the Commonwealth of Pennsylvania, as provided by law.
The said Articles of Incorporation[1] shall be as follows:
A. 
The name of the Authority shall be "Central Delaware County Authority."
B. 
The Authority is formed under the provisions of the Acts of Pennsylvania--No. 191, Session of 1935, and No. 200 of the Session of 1937.[2]

C. 
That no other Authority organized under the Municipal Authority Act of 1937 (Act No. 200), nor under the Act approved December 27, 1933 (Special Session--1933--P.L. 114),[3] is in existence in or for the incorporating municipalities.

D. 
The names of the incorporating municipalities, together with the names and addresses of its municipal officers, are as follows:[4]
The Township of Springfield
The Township of Ridley
The Township of Nether Providence
The Borough of Swarthmore
The Borough of Rutledge
The Borough of Morton
The Borough of Prospect Park
The Borough of Ridley Park

E. 
The names and addresses and terms of office of the first members of the Board of the said Authority are as follows.[5]

F. 
Commissioners or Councils, as the case may be, of each municipality creating the said Joint Authority shall appoint one member of the Board. The Townships of Ridley and Nether Providence shall appoint one member each for a period of four years; the Borough of Swarthmore and the Township of Springfield, for a period of three years; the Boroughs of Ridley Park and Prospect Park, for a period of two years; and the Boroughs of Rutledge and Morton, for a period of one year; and thereafter the said Commissioners or Councils, as the case may be, shall, at a meeting held not later than one month prior to January 1 in each year in which a vacancy occurs in the office filled by that municipality, appoint, as a member of the Board, a citizen of that municipality for a term of four years, to succeed the member whose term expires on January 1 next succeeding. All vacancies shall be filled by the governing body of the municipality whose appointee has vacated his office.
IN WITNESS WHEREOF the municipalities appointed herein have hereunto caused to be written their respective names, signed by their presiding officer and attested by their Secretary, or Clerk, this 13th day of October A.D. 1937.

Editor's Note: Ordinance No. 773, approved 9-14-1960, adopted the amendment to the Articles of the Central Delaware County Authority proposed by the Board of said Authority and submitted to the municipalities composing it, which amendment increased the term of existence of the Authority to September 21, 2010. Ordinance No. 1265, adopted 5-10-2005, approved 5-10-2005, adopted and approved an amendment to the Articles of Incorporation of the Central Delaware County Authority, which amendment increased the term of existence of the Authority to June 1, 2055.
