As used in this chapter, the following terms shall have the meanings indicated:
SELF-SERVICE GASOLINE STATION
A property and/or place of business where flammable or combustible liquids are used as motor fuels and are stored and dispensed from fixed equipment into fuel tanks of motor vehicles by a person other than the service station attendant and which is licensed by and complies with all regulations of the State of Pennsylvania.
Approved special dispensing devices, such as but not limited to coin-operated, card-operated and remote preset types are permitted at service stations, provided that there is at least one qualified attendant on duty while the station is open to the public. The attendant's primary function shall be to supervise, observe and control the dispensing of flammable or combustible liquids while said liquids are being dispensed. It shall be the responsibility of the attendant to prevent the dispensing of Class 1 liquids into portable containers not in compliance with § 88-10 hereof, control sources of ignition and to immediately handle accidental spills and fire extinguishers if necessary. It shall be required that any attendants be familiar with and know how to operate all emergency shutdown pump controls and other emergency equipment on the site and, also, to be completely familiar with all emergency service telephone numbers in the community.
The attendant or supervisor on duty shall be capable of performing the functions and assuming the responsibilities covered in this chapter and be at least 18 years of age.
A. 
Emergency controls, including main power shutoff switch or switches, shall be installed at a location not more than 15 feet from the attendant's principal control location and not more than 100 feet from the dispensers.
B. 
Instructions for the operation of the dispensers shall be conspicuously posted on either the dispenser or at the dispenser island.
The dispensing operations shall at all times be in clear view of the attendant, and the placing or permitting of any obstacle to come between the dispensing operation and the attendant so as to obstruct the attendant's view is prohibited and shall be reason to immediately close down the operation of such station until the obstruction is removed.
A voice communication system, such as but not limited to an intercom system, so as to allow direct voice communication at all times between the person dispensing flammable or combustible liquids and the attendant shall be required and maintained.
On each dispenser island there shall be conspicuously posted, in letters at least one inch in height, the following warnings:
WARNING -- IT IS UNLAWFUL TO DISPENSE GASOLINE INTO ANY PORTABLE CONTAINER UNLESS THE CONTAINER IS CONSTRUCTED OF METAL OR IS APPROVED BY THE FIRE MARSHAL
NO SMOKING
STOP MOTOR
Dispensing of Class 1 liquids shall not be made into portable containers unless the container is of sound metal construction, has a right closure with screwed or spring cover and is fitted with a spout or so designed that the contents may be poured without spilling. Containers shall be clearly marked with the name of the product contained therein.
If the dispensing of flammable or combustible liquids, at a service station available and open to the public, is to be done by a person other than the service station attendant, the nozzle shall be an approved automatic-closing type without a hold-open latch.
Service stations accessible to the public shall have an attendant or supervisor on duty whenever the station is open for business. Said attendant shall be completely familiar and capable of doing all procedures set forth in § 88-2 of this chapter. Said attendant shall not be cashier and/or attendant for any food service operation.
A. 
There shall be no smoking on the driveway of service stations in the areas used for fueling motor vehicles, dispensing flammable antifreeze or the receipt of products by tank truck nor in those portions of the building used for servicing automobiles, tractors or internal combustion engines. Conspicuous signs prohibiting smoking shall be posted within the sight of the customer being served.
B. 
The motors of all vehicles being fueled shall be shut off during fueling operation.
C. 
Use of Class 1 liquids at service stations and garages as degreasing or cleaning agents shall be prohibited.
There shall be at least one 10BC fire extinguisher in each service station at the attendant's principal control location. There shall be at least one 5BC fire extinguisher clearly displayed and marked, located at each dispenser island.
Any part of this chapter held to be inconsistent or overwritten by the rules and regulations of the State of Pennsylvania shall, when found to be inconsistent, no longer be effective, but said inconsistency will not affect the validity of any other part of this chapter.
