The Fire Hydrant Rental Agreement tendered by the Municipal Water Authority
of Aliquippa to the Board of Supervisors of the Township of Raccoon applicable
to fire hydrant service to be provided in the Township of Raccoon is hereby
approved.
Said Fire Hydrant Rental Agreement shall be executed for and on behalf
of the Township of Raccoon by the Chairman of its Board of Supervisors, attested
by the Secretary of said Board, and the Seal of the Township shall be affixed
thereto.
The Board of Supervisors hereby authorizes and directs that the Township
of Raccoon pay annually to the Municipal Water Authority of Aliquippa the
annual rental set forth in said Fire Hydrant Rental Agreement for each fire
hydrant connected to the water distribution system within the Township of
Raccoon and rendering fire hydrant service in the area of the Township of
Raccoon served by the Municipal Water Authority of Aliquippa within the Township
of Raccoon and any extensions thereof within the Township of Raccoon. These
payments shall be made in accordance with said Fire Hydrant Rental Agreement.
The said payments under said Fire Hydrant Rental Agreement shall be
paid from annual assessments for fire hydrant service made by the Township
of Raccoon by an equal annual assessment upon all property, whether or not
exempt from taxation by existing law, within 780 feet of any fire hydrant
based upon the assessment of property for county tax purposes.
All such assessments for fire hydrant service shall be filed with the
Township Tax Collector and billed on the annual real estate tax bill for Township
purposes. The Tax Collector shall be entitled to the same commission for the
collection of the fire hydrant assessment as for the collection for the general
Township tax. The assessment for fire hydrant service shall be due and payable
30 days after notice thereof has been given to the property owner. The Township
Treasurer shall receive all such assessments collected for fire hydrant service
and keep the same in a separate account and make payments of same as provided
by the Fire Hydrant Rental Agreement. The Township Treasurer shall make a
report to the auditors of the Township annually with regard to same. If any
assessment remains unpaid 90 days after the due date, it shall be turned over
to the Township Solicitor for collection by means of an action in assumpsit
for recovery or a municipal lien filed against the property of the delinquent
owner for the amount of the unpaid assessment, plus interest at the rate of
24% per annum, not compounded, plus attorney's fees as set from time to time
by resolution of the Board of Supervisors for the filing of any such action
in assumpsit or a municipal lien plus all other reasonable attorney's fees
incurred by the Township in collection by means of an action in assumpsit
or a municipal lien, plus the costs of said proceedings. If an owner has two
or more lots against which there is a delinquent assessment for the same year,
the lots shall be embraced in one claim.
