As used in this chapter, the following terms shall have the meanings indicated:
OFF-ROAD VEHICLES
A motor-driven vehicle of any kind other than one equipped for and registered for use on the highway, including, without limitation, four-wheelers, all-terrain vehicles, motorcycles, dirt bikes, dune buggies and other similar motor-driven conveyances.
A. 
No person shall operate an off-road vehicle on any private property or public property within the Township unless such person has in his possession written permission from the owner of the property to operate such vehicle on the property. Such written permission shall be exhibited to any Law Enforcement Officer upon request.
B. 
No person shall provide, entrust or allow to possess an off-road vehicle by any person under the age of 18 years unless such person has written permission in his possession to operate the vehicle on the property on which it is possessed.
A. 
The penalty for violation of this chapter, upon conviction, shall be a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof.

B. 
Any off-road vehicle being used in connection with a second or subsequent offense under this chapter shall be subject to forfeiture to the Township upon order of the municipal court.
C. 
Any off-road vehicle found to be in use in violation of this chapter by any law Enforcement Officer shall be subject to impoundment until the disposition of any charges under this chapter and shall be released only to a parent or legal guardian of any person under the age of 18 years upon demonstration of proof of ownership of same.
It shall be presumed that any person under the age of 18 who operates a motor driven vehicle in violation of the terms of this section, and who resides with their parents, guardian or other person having custody of such person, who is operating the vehicle with the sufferance and permission of such parent, guardian or other person and each of these persons shall be subject to prosecution to the same extent as the minor who actually operates the vehicle in violation of this section.
