All traffic and parking regulations of a permanent
nature shall be enacted as ordinances, as parts of ordinances, as
amendments to ordinances, or as amendments to this article, except
where the law specifically authorizes less formal action.
The provisions of this article, so far as they
are the same as those of ordinances and regulations in force immediately
before the enactment of this article, are intended as a continuation
of those earlier ordinances and regulations, and not as new enactments.
Nothing in this article shall affect any act done or liability incurred,
or any suit or prosecution pending or to be instituted under any of
those repealed or superseded ordinances or regulations.
The Borough Council may, from time to time by
resolution, designate places upon and along the highways in the Borough
where, for a period of not more than 90 days, specific traffic and/or
parking regulations, prohibitions and restrictions shall be in force
and effect, and shall designate such locations by proper signs and
markings. Such regulations, prohibitions and restrictions shall be
effective as if they had been specified in this article. No person
shall operate and no person shall move, remove, destroy or deface
any sign or marking erected, posted or made by authority of this section.
Any person who shall violate any provision of this section shall,
upon conviction thereof, be subject to the penalty set forth in the
law or elsewhere in this article for a violation of such nature, and
in case of a violation for which no specific penalty is set forth
in the law or elsewhere in this article, to a fine of not more than
$25 together with costs of prosecution; provided, the purpose of this
section is to allow for the test and experimental determination of
the feasibility and desirability of permanent changes in the ordinances
of the Borough of Rosslyn Farms relative to traffic and parking.
The police officers of the Borough are hereby
authorized to direct traffic on the highways of the Borough and at
intersections thereof and to otherwise enforce the provisions of this
article.
When possible to avoid, no person shall cause
traffic to be obstructed, interfered with or annoyed, or shall cause
danger, annoyance, discomfort, or inconvenience to any person or injury
to person or property.
When parking on a two-way highway vehicles shall
be positioned parallel to and with the righthand wheels within 12
inches of the righthand curb or, in the absence of a curb, as close
as practical to the right edge of the righthand shoulder unless lines,
arrows or other directions are applicable to the particular place.
To conserve parking space each vehicle shall be driven within four
feet of any other vehicle parked in the immediate vicinity or to the
limit of the position wherein parking is permitted, and shall park
within lined spaces when so marked.
In addition to the other provisions and exceptions
herein, no vehicles shall be parked at or next to a curb painted yellow
by the Borough, or where signs are placed and maintained by the Borough
indicating that parking is prohibited.
Whether occupied or not, no vehicle of the following
classes or types, as defined either in this chapter or in the Pennsylvania
Vehicle Code,shall be permitted to remain parked or left standing in
or on any public street, highway, alleyway or right-of-way within
the Borough of Rosslyn Farms between 10:00 p.m. and 6:00 a.m., prevailing
time:
No person shall place any signs or paint any
curb to regulate traffic in highways except under proper municipal
authority and after approval of the Mayor or other person designated
by Council.
It shall be unlawful for any person to place
any pedestals, posts, signs, lights, wires, other fixtures or apparatus
on, under or over any highway of the Borough unless by direction of
Borough Council or as otherwise approved by it.
Any person, firm or corporation causing damage
to be done to any traffic light or traffic standard or to other construction
of the Borough shall pay the damages caused and be deemed guilty of
having violated this article.
