The following acts are hereby prohibited: owning, possessing, harboring
or controlling any animal or bird which barks, bays, cries, squawks or makes
any other noise continuously and/or incessantly for a period of 20 minutes
or makes such noise intermittently for one hour or more to the disturbance
of any person at any time of the day or night regardless of whether the animal
or bird is physically situated in or upon private property: provided, however,
that at the time the animal or bird is making such noise no person is trespassing
or threatening to trespass upon private property in or upon which the animal
or bird is situated or for any other legitimate cause which teased or provoked
the animal or bird. For purposes of this article intermittent shall be defined
as a minimum of three 10 minute intervals during any one hour period.

A. Abatement process. The Township shall issue one warning
notice by certified mail, return receipt requested, when a complaint is registered
and verified. If the Township receives a second verified complaint concerning
the same violation within 15 days of the first complaint, the Township shall
issue an appropriate citation.
B. Penalties. Any person, firm or corporation who shall
violate any provision of this article shall, upon conviction thereof, be sentenced
to pay a fine of not more than $1,000 plus costs and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 30 days. Each
day that a violation of this article continues shall constitute a separate
offense.
