A. 
No person shall possess or consume any alcoholic beverage in or at any Township park property operated, contributed to, or owned by the Township of Whitehall or upon any thoroughfare, street, sidewalk, alley, public parking lots or any other public way adjacent thereof.
B. 
Definition, alcoholic beverage. Any spirits, wine, beer, ale or other liquid containing more than 1/2 of 1% of alcohol by volume, which is fit for beverage purposes or intended for beverage purposes.
C. 
As an exception to the foregoing, alcoholic beverages may be allowed in the following buildings pursuant to securing a permit from the responsible playground organization:
(1) 
Fullerton Memorial Community Center.
(2) 
West Catasauqua Playground Community Building.
(3) 
Zephyr Park Playground Community Building.
(4) 
Cementon Playground Community Building.
(5) 
Egypt Memorial Playground Community Pavilion.
(6) 
Hokendauqua Playground Community Pavilion.
D. 
In order to possess or consume alcoholic beverages outside of the designated location, application must be made to the Mayor or his designee for a special events permit which shall set forth the areas and types of drinks allowed with such approval not to be unreasonably withheld.

Before issuing a citation for a violation of this article, any Police Officer of the Township shall give an oral warning, or issue a written warning ticket. If the person or persons receiving the oral warning or warning ticket does not discontinue the violation, a citation for ordinance violation shall be issued to the violator. If it appears necessary to make an arrest to preserve the public peace, a police officer may make an arrest for a violation of this article, with or without a previous oral warning or warning ticket.
B. 
Warning not required. Police officers shall use discretion with respect to enforcement of this article. However, no warning, verbal or written, shall be required for those violations in which signs and/or notices are properly posted.
Signs shall be posted and notices shall be placed on bulletin boards in the Township park property, stating substantially as follows: "Alcoholic Beverages Prohibited in this article Except with a Special Permit in Designated Areas. Township Ordinance in Force." The signs shall be placed in locations to be visible on entering the park or parkland.
Any person, firm or corporation violating any provision of this article shall be fined not less than $5 nor more than $500 for each offense, and a separate offense shall be deemed committed on each day during or on which the violation occurs or continues.
