This article provides for the regulation of all fences permitted by Whitehall Township ordinances which now contain or may in the future contain wires with barbs or fences which are or may be in the future electrified in the Township of Whitehall, Pennsylvania.

A. 
Fences or similar purpose installations shall not contain any barbs or similar devices in the area of five feet or less from the ground inasmuch as they are deemed a hazard to children and the public health, safety and general welfare.
B. 
Fences or similar purpose installations shall not be electrified inasmuch as they are deemed a hazard to children and the public health, safety and general welfare.
Should any fence or similar installation presently exist in the Township which constitutes a violation of this article, the owner or occupier or both shall remove the same by no later than July 30, 1969. No fences or similar purpose installation shall be constructed, built or maintained within the Township of Whitehall that are in violation of the tenets hereof.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
