As used in this chapter, the following words or phrases shall have the meanings ascribed to them in this section:
ABANDONED (ON PUBLIC PROPERTY)

Any vehicle, trailer, boat, appliance, household furnishing or other item resting, stored or placed on any public property in the Borough of Youngwood which meets any one of the following criteria:
A. 
Is inoperable or is without a current registration certificate, plate or inspection sticker;
B. 
Is in such condition as to be unusable for its intended use;
C. 
Is being stripped or being used or sold for parts.
ABANDONED (ON PRIVATE PROPERTY)

Any item resting, stored or placed on any private property in the Borough of Youngwood for 48 hours or more which meets any one of the following criteria
A. 
Is inoperable or is without a current registration certificate, plate or inspection sticker,
B. 
Is in such condition as to be unusable for its intended use;
C. 
Is being stripped or being used or sold for parts.
APPLIANCE
A stove, refrigerator, television, furnace, water heater, water softener, washer, dryer or mangle, household articles used to perform any of the necessary work in a household and articles used in business to increase production or to speed, ease or eliminate work.
BOAT
Any vessel capable of transporting a person on any river, stream, creek, lake or ocean.
DISCARDED (ON PUBLIC PROPERTY)

Any item resting, stored or placed on any public property in the Borough of Youngwood, Westmoreland County, Pennsylvania that has no known or apparent owner.
DISCARDED (ON PRIVATE PROPERTY)

Any item resting, stored or placed on any private property in the Borough of Youngwood, Westmoreland County, Pennsylvania for 48 hours or more that has no known or apparent owner.
HOUSEHOLD FURNISHING
Includes all items normally found and used in a home.
JUNKED
Items sold or to be sold for scrap, being stripped or being used or sold for parts.
PERSON
A natural person, the members of an unincorporated association, all of the partners of a partnership and the officers and Board of Directors of a corporation.
TRAILER
A wheeled device used as a means of carrying, hauling, or conveying any vehicle, person, animal, object or boat.
VEHICLE
An automobile, motorcycle, motorbike, minibike, bicycle, go-cart, truck or other wheeled means of conveyance, motorized or self-propelled.

A. 
It shall be unlawful for any person to accumulate, store or place any junked, abandoned or discarded vehicle, trailer, boat, appliance, household furnishing or other item on public property in the Borough of Youngwood, Westmoreland County, Pennsylvania, for any period of time.
B. 
It shall be unlawful for any person to accumulate, store or place any junked, abandoned or discarded vehicle, trailer, boat, appliance, household furnishing or other item on private property within the Borough of Youngwood, Westmoreland County, Pennsylvania, for 48 hours or more.

A. 
Any person convicted of violating § 122-2 of this chapter before a District Justice or other appropriate judicial authority, shall be sentenced to pay a fine of not less than $25 nor more than $300, plus costs of prosecution, for each offense and, in default of payment of such fine and costs, shall undergo imprisonment in the county jail for not more than 30 days. Each day the person is in violation of § 122-2 of this chapter shall constitute a separate offense. In addition, the owner of any abandoned vehicle which is towed or stored, pursuant to the provisions of this chapter or any provision of the Pennsylvania Vehicle Code,[1] shall be assessed the costs of said towing and/or storage as an additional fine. The assessment for towing shall be $25 or the actual cost incurred by the borough, whichever is higher. The assessment for storage shall be $10 per day or the actual cost incurred by the borough, whichever is higher.

B. 
All legal proceedings under this chapter shall be brought before any District Justice or other appropriate judicial authority in accordance with applicable rules of procedure.
