A. 
City Council action. The City Council shall be responsible to the electorate for the efficient and economical management of the city government. It shall deal with legislative matters as a body and effectuate its policy decisions solely through the office of the City Manager, as hereinafter established. City Council members shall not negotiate individually with the City Manager or with any department or bureau head regarding any matter for which the City Council as a whole is responsible under this Charter.
B. 
Departmental organization. The administrative, executive and judicial functionspowers and duties of the city government shall be exercised and discharged by the following departments, offices and agencies, as provided in this Charter:

(1) 
City Council.
(2) 
City Manager.
(3) 
Department of Administration.
(4) 
Department of Assessment.
(5) 
Department of Public Works.
(6) 
Department of Public Safety.
(7) 
Board of Assessment Review.
(8) 
Parks and Recreation.
(9) 
Senior Center.
(10) 
Department of Planning and Economic Development.
(11) 
Such other departments, offices and agencies as are specified or created by resolution of the City Council or by law.
C. 
Department heads; general. The head of a department in the city government, in addition to such other powers and duties as are elsewhere provided by this Charter, shall:
(1) 
Plan, organize and administer the work of the department, subject to the direction and supervision of the City Manager.
(2) 
Prepare and justify the annual requests of the departments for appropriations.
(3) 
Review and, where appropriate, approve all invoices and vouchers chargeable to appropriations made for the department, and append thereto certifications that the work, labor or services for which payment is demanded has been rendered, or that goods, materials or equipment have been received and delivered and that to their best knowledge, information and belief, the amount demanded is lawfully due and owing by the city.
A. 
There shall be a Department of Administration, the head of which shall be the City Manager.
B. 
The City Finance Director shall be the Chief Fiscal Officer of the city and shall devote full time to the duties of this office. Prior to appointment, the City Manager shall be satisfied that the City Finance Director possesses the training, education and experience necessary to perform the duties of the position.

C. 
The City Clerk shall be the chief recordkeeping officer of the city and shall devote full time to the duties of this office. Prior to appointment, the City Manager shall be satisfied that the City Clerk possesses the training, education and experience necessary to perform the duties of the position.
D. 
For services performed, the City Clerk and City Finance Director each shall receive an annual salary fixed by the City Manager.

The City Clerk shall be the custodian of the seal of the city and all records, books and documents of the city, other than those committed by Charter, local law or ordinance to some other office or transferred thereto by the City Manager. The City Clerk, subject to the direction and supervision of the City Manager, among other duties specified in this Charter, shall:
A. 
Upon request and upon payment of fees prescribed pursuant to the law for use of the city, furnish a certified copy of any record, document or paper in the City Clerk's custody, under the corporate seal of the city.
B. 
Cause the corporate seal to be affixed to such instruments and writings as may be authorized by local law or ordinance, or as may be required by general law.
C. 
[1]Serve as Registrar of Vital Statistics unless the City Manager makes other provisions for such function; perform all other functions required of a City Clerk by any state law and administer such provisions of local laws and ordinances which require licenses, permits or certificates to be obtained from a City Clerk.

D. 
Serve as Clerk of the City Council and shall:
(1) 
Attend all meetings of the City Council and, when required, of its legislative committees.
(2) 
Keep full and accurate minutes of each meeting of the City Council and arrange for their preservation in properly bound and indexed volumes.
(3) 
Record, bind and preserve the local laws, ordinances and resolutions of a permanent character passed by the City Council; and the Mayor or any other presiding officer shall sign and the City Clerk shall certify each such local law, ordinance or resolution attesting that it was duly adopted upon a date stated; and the copy so signed and certified shall be deemed to be a public record of the local law, ordinance or resolution.
(4) 
At the close of each year, with the advice and assistance of the City Attorney, bind, compile and codify all of the local laws, ordinances and resolutions or true copies thereof, which then remain in force and effect, and properly index such record, compilation or codification.
E. 
Countersign all contracts, deeds, leases, permits, franchises, licenses and such other written instruments authorized by the City Council, City Manager or by law.
F. 
Receive and collect all fees, charges and moneys from the granting of licenses, permits and other fee services rendered by the Office of the City Clerk. After allocating fees as may be required by law, all moneys so received shall be delivered to the City Finance Director for deposit.

G. 
Furnish to the City Finance Director each month a record of all moneys which belong to the city received by him/her.

H. 
Perform such other duties or services as directed by the City Manager relating to the affairs of the city or as otherwise directed by this Charter.
I. 
Attend all meetings necessary to perform assigned duties of the office.
J. 
Produce, upon reasonable demand, all books and papers in his/her office for the inspection of any elector of the city and shall furnish copies of all papers and records, at a reasonable fee, in accordance with Article 6 of the Public Officers Law or as otherwise provided by Title 5 of the Local Finance Law.

The City Finance Director, subject to the direction and supervision of the City Manager, among other duties specified in this Charter, shall:
A. 
Exercise commonly accepted or statutorily required accounting functions as are necessary to confirm that the financial records are kept in accordance with standard municipal accounting procedures and that all necessary financial reports are made by all officers and employees.
B. 
Have such other, different and additional functions, powers and duties as may be prescribed by local law or ordinance or delegated by the City Manager.
C. 
Be responsible for the receipt, safekeeping and disbursement, after authorization by the City Manager, of all moneys belonging to the city.
D. 
Be custodian of all securities and obligations or other evidence of debt belonging to the city, except as otherwise provided by state statute.
E. 
Shall enter daily all receipts and payments, in such manner as to exhibit the several amounts paid by him/her or to him/her under each class of purposes for which money shall be raised by tax, with the name of each person, by, to or from whom and on what account the same shall have been paid.
F. 
From time to time, and at such times and manner as the City Manager shall direct, deposit moneys in such bank(s) as shall be approved by the City Council.
G. 
Be responsible for the payment, after authorization by resolution of the City Council, of all moneys belonging to the city to be paid out of the treasury. No such moneys shall be paid out of the treasury without authorization by the City Manager for expenditure of budgeted moneys and Abstract of Claims countersigned by the City Manager. All items on the Abstract of Claims shall indicate the voucher number, supplier or vendor, the amount to be paid and to what fund it is chargeable.
H. 
Collect and receive at his/her office all city and county taxes and assessments and delinquent school taxes due the city.
I. 
Transmit, in the manner and within the time required by law, to the Treasurer of Steuben County all state and county taxes received by him/her.
J. 
Submit to the City Manager at the end of each fiscal year a statement of all delinquent school and city taxes due the city.
K. 
Submit, not later than April 1 in each year, to the City Manager, a statement of the principal and interest of the bonded municipal debt falling due within the ensuing fiscal year.[1]

No department, office or agency of the city government shall expend or commit any funds of the city unless the City Manager or his/her designee shall first certify that there is an unencumbered balance of appropriation and funds available for the purpose, as provided in Article X, Budget and Finance.

A. 
Upon the City Clerk or City Finance Director leaving office, all assessment rolls, papers and books pertaining to the affairs of the city shall be turned over to the City Manager or his/her successor.
B. 
Failure of the City Clerk or City Finance Director to account for or pay over all moneys as required by this section, or other sections of this Charter, shall be breach of the condition of his/her bond, for which the City of Corning shall have a cause of action against him/her and his/her sureties. The city shall be entitled to recover in any such action all sums of money remaining unpaid or unaccounted for by the City Clerk or City Finance Director on all damages sustained by the city by reason thereof, plus costs. Any City Clerk or City Finance Director who shall willfully misappropriate or mishandle any moneys, securities, obligations or other evidence of debts belonging to the city in violation of this Charter or state law shall upon conviction be punished as provided for by law.
