All abutting property owners of Water District
No. 5 shall hereby connect with and use the water lines provided herein.
In the event that any owner of said property shall neglect or refuse
to connect with and use said water system for a period of 90 days
after notice to do so has been served upon him by the Township of
Middletown, either by personal service or registered mail, the Supervisors
or their agents may enter upon said property and construct such connection.
In such case, the Supervisors shall forthwith, upon completion of
the work, send an itemized bill for the cost of construction of such
connection to the owner of the property to which connection has been
made, which bill shall be payable forthwith, or the Supervisors may
authorize the payment of the cost of construction of connection in
equal monthly installments, said installments bearing interest at
a rate not to exceed 7% per annum. In case of the neglect or refusal
by the owner of a property required to connect to said system to pay
said bill or installment payment, the Township Supervisors shall file
a municipal lien for the said construction within six months of the
date of completion of said connection, the same to be subject in all
respects to the general law providing for the filing and recovering
of municipal liens.
