GENERAL REFERENCES

There is hereby established and constituted
a Civil Service Commission which shall consist of three commissioners
who shall be qualified electors of the Borough of Derry.
Initially, Council shall appoint one person
to serve on said Commission for two years, one person to serve for
four years and one person to serve for six years. Upon the expiration
of the term of any member of said Commission, one person shall be
appointed by the Borough Council to serve on said Commission for the
term of six years or until his successor is duly appointed and qualified.
If any vacancy occurs in said Commission, it
shall be filled by the Borough Council for the unexpired term within
the period of 30 days after such vacancy occurs.
The Civil Service Commission of the Borough
of Derry shall provide for and regulate the examination of applicants
for and the manner of appointment and selection of persons for positions
in the Police Department, in accordance with the Acts of Assembly
now in force or hereafter enacted, except in the case of a vacancy
in the office of the Chief of Police, when the procedure set forth
in § 1184 of the Borough Code[1] shall be followed in filling the vacancy.

The duties of said Commission shall be such
as prescribed by the Acts of Assembly of the Commonwealth of Pennsylvania
authorizing and requiring the establishment of civil service commissions
in boroughs employing three or more policemen.
No salary or other compensation shall be paid
to any member of the Commission. Two members of the Commission shall
constitute a quorum necessary for the transaction of business and
no action of the Commissioners shall be valid unless it shall have
the concurrence of at least two members and said Commissioners shall
organize as required by the Acts of Assembly now in force in the Commonwealth
of Pennsylvania and shall be subject to and governed by the Acts now
in force or hereafter enacted.
Each member of the Commission, before entering
upon the discharge of his or her office, shall take an oath or affirmation
to support the Constitution of the United States and of the Commonwealth
of Pennsylvania and to perform his or her official duties with fidelity
together with such loyalty oath as is prescribed and required by law.

There is hereby established and constituted
two official alternates to the Civil Service Commission, said alternates
designated first alternate and second alternate.

Each alternate shall be appointed to serve until
the alternate's successor is duly appointed and qualified.

The purpose of the alternates is not for the
reason that a vacancy has occurred on the Civil Service Commission,
as vacancies are specifically provided for by law, but so that in
the event a vacancy occurs due to death or resignation or for any
other valid or lawful purpose, then and in that event there will be
two alternates familiar with Civil Service Commission rules and regulations
and available immediately for appointment by Council to fill any vacancy
on the Civil Service Commission which has occurred.

The alternates to the Civil Service Commission
may attend upon invitation by the Civil Service Commission any hearing
or proceeding before the Civil Service Commission other than a hearing
or proceeding which has been requested to be private or a session
in which the Civil Service Commission would be engaged in deliberations
to form a decision, and it is hoped that the alternates to the Civil
Service Commission will attend any and all proceedings possible so
as to familiarize themselves with Civil Service procedures, rules
and regulations and so that the alternates would be able to be appointed
to the Civil Service Commission as members when vacancies occur.

It is further understood and agreed that even
though alternates shall most certainly be given preference by Council
for appointment to the Civil Service Commission when a vacancy occurs,
this is not to be construed as meaning that Council must appoint the
alternates to fill vacancies, as Council shall retain the right to
appoint members to the Civil Service Commission as is so provided
by law.

Should an alternate be appointed to serve on
the Civil Service Commission or of course any other person so designated
by Council, then such alternate or person entering upon the discharge
of his or her office shall take an oath or affirmation to support
the Constitution of the United States and of the Commonwealth of Pennsylvania
and to perform his or her official duties with fidelity together with
such loyalty oath as is prescribed and required by law.
