A.
There is hereby established in the Village of Ridgefield
Park a State Uniform Construction Code enforcing agency to be known
as the "Building Department," consisting of a Construction Official,
Building Subcode Official, Plumbing Subcode Official, Electrical Subcode
Official, Fire Protection Subcode Official and such other subcode
officials for such additional subcodes as the Commissioner of the
Department of Community Affairs, State of New Jersey, shall hereafter
adopt as part of the State Uniform Construction Code. The Construction
Official shall be the chief administrator of the enforcing agency.
All personnel shall be appointed or assigned to the Building Department
by the Commissioner in charge of that particular agency or section.
B.
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217 (N.J.S.A. 52:27D-119 et seq.), as amended by N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217 and N.J.A.C. 5:23 to hold each such position.
B.
Public buildings (County and Village). No fee shall
be charged for any type of construction permitted for any building
or structure owned by the County of Bergen or the Village of Ridgefield
Park or any of their subordinate agencies.
C.
The Construction Official, with the advice of the
subcode officials, shall prepare and submit to the Board of Commissioners
of the Village of Ridgefield Park biannually a report recommending
a fee schedule, based on the operating expenses of the agency and
any other expense of the municipality fairly attributable to the enforcement
of the State Uniform Construction Code Act.[2]

All appointments, qualifications for appointment, internal procedures, hearings and notice relative thereto, appeals and filing therefor shall be and they are hereby governed by Chapter 217 of the Laws of New Jersey 1975 (N.J.S.A. 52:27D-119 et seq.) and Title 5, Chapter 23, of the New Jersey Administrative Code, as amended and supplemented, three copies of each being on file in the Building Department and office of the Village Clerk.
Upon publication and passage as prescribed by
law, this chapter shall be filed and recorded with the Bureau of Housing
Inspection, New Jersey Department of Community Affairs, and retained
on file as a public record in the offices of the Village Clerk, Construction
Official and Building Department.
B.
In the event the State of New Jersey has or does establish
a uniform system for fines and penalties under P.L. 1975, c. 217,
as amended by N.J.A.C. 5:23 (N.J.S.A. 52-27D-119 et seq.), then that
particular fine or penalty shall govern any occurrences where a person,
firm or corporation shall violate any of the provisions of this chapter.
