As used in this chapter, the following terms
shall have the meanings indicated:
BOW, CROSSBOW
Any device capable of firing or launching an arrow, bolt,
shaft, dart or other projectile by means of a spring, elastic band,
string leverage device or any other mechanical force.
FIREARM
Any pistol, revolver, sawed-off shotgun or other firearm
of a size which may be concealed upon the person, including any antique
firearm as defined by § 265 Subdivision 14 of the New York
State Penal Law.
FIREWORKS
The meaning as defined in § 270 of the Penal Law
of the State of New York.
RIFLE
A weapon designed or redesigned, made or remade and intended
to be fired from the shoulder and designed or redesigned and made
or remade to use the energy of the explosive in a fixed metallic cartridge
to fire a projectile through a rifled bore.
SHOTGUN
A weapon designed or redesigned, made or remade, and intended
to be fired from the shoulder and designed or redesigned and made
or remade to use the energy of the explosive in a fixed shotgun shell
to fire through a smooth bore either a number of ball shot or a single
projectile.
SLINGSHOT, CARPET GUN
Any device capable of firing or launching a pellet, ball,
stone, tile or other projectile by means of a spring, elastic band,
string leverage device or by use of any other mechanical or centrifugal
force.
VILLAGE
All lands and areas within the boundaries of the Incorporated
Village of Montgomery, Orange County, State of New York.
No person or persons, with the exception of
a peace officer or peace officers in the performance of their duty,
shall at any time, discharge or cause to be discharged any firearm,
rifle, shotgun, BB gun, air rifle, air pistol, blow gun, slingshot,
carpet gun, bow, crossbow, rocket or gun powder or set off any fireworks
or other explosives, incendiary device or rapid combustible within
the Village except with special written permission and or permit from
the Village Board of Trustees.
No person or persons, with the exception of
a peace officer or any other such person duly licensed by the county
or State of New York shall carry any armed or loaded firearm, rifle,
shotgun, BB gun, air rifle, air pistol, blow gun, slingshot, carpet
gun, bow, crossbow, rocket or explosive or combustible device within
the Village without special written permission or permit from the
Village Board of Trustees.
No person or persons shall hunt with any type
of weapon or device within the Village except under special conditions
and only then with special written permission and or permit from the
Village Board of Trustees.
If any damage or expense shall be suffered or
sustained by the Village, a Village resident, property holder, lessee,
visitor or other person or persons to real estate, property, personal
property, chattels or person, because of any such acts prohibited
in this chapter, the person or persons so engaged in such acts or
in the case of a minor, his parents or guardians, will and shall be
liable for such damages, costs and expenses sustained or suffered
because of the performances of such acts.
Any violation of any provision of this chapter
shall, upon conviction, be punishable by a fine not exceeding $250
or a term of imprisonment for not more than 15 days or both for each
offense.
