The Borough Council finds as a fact that the use of skateboards on public sidewalks, alleys and streets is a hazard of the users of the skateboards and to the safety of other persons using such sidewalks, alleys and streets.
It shall be unlawful for any person to use, ride, propel, or otherwise operate a skateboard on the public sidewalks, streets, alleys and on Borough-owned properties (except areas specified by Recreation Council and under their jurisdiction for skateboarding within the Borough of New Freedom).
Any person violating this chapter shall be guilty of a summary offense and shall, upon first conviction, be sentenced to pay a fine of not less than $15, plus costs of prosecution. Any person convicted of violating this chapter for a second or subsequent time shall be sentenced to pay a fine of not less than $75, nor more than $300, plus costs of prosecution.
