This is a curfew ordinance prescribed, in accordance with prevailing community standards, regulations for the conduct of children under the age of 18 years on streets at night, for the protection of younger children in the Borough of Loganton from each other and from other persons on the streets during nighttime hours, for the enforcement of parental control and responsibility for their children, for the protection of the public from nocturnal mischief by children under the age of 18 and for the reduction of the incident of juvenile criminal activity, all for the good of children under the age of 18, for the furtherance of family responsibility and for the public good, safety, and welfare.

No person under the age of 18 years shall be upon any of the public streets, highways, alleys, parks, playgrounds, public buildings or other public places of the Borough of Loganton or in any enclosure or vehicle which is on or in close proximity to any such public place within the Borough of Loganton between the hours of 10:00 p.m., Sunday through Thursday, and 11:30 p.m. on Friday and Saturday and 6:00 a.m. on the following day. Exceptions to the above are the following:
A.
Persons under 18 years who are accompanied by a parent, guardian, or other individual having legal care or custody of said person or persons;
B.
Persons under 18 years who possess a written statement dated that day and signed by parent, guardian or other person having the legal care or custody of such individual, which statement specifies the time, place, purpose and necessity of the individual being in a public place contrary to this chapter;
C.
Persons under 18 years who are lawfully employed making it necessary to be on or in highways, streets, parks, etc., as stated above, and possessing a current letter certifying the same and signed by the employer, parent or guardian;
D.
Persons under 18 years who are on an emergency errand;
No parent, guardian or other person having legal care or custody of a child of a person under the age of 18 years shall allow or permit such person to be in or upon any of the public streets, highways, parks, etc. or any other public place of the Borough of Loganton between the hours of 10:00 p.m., Sunday through Thursday, and 11:30 p.m. on Friday and Saturday and 6:00 a.m. prevailing time, on the following day.
Any parent, guardian or other person having legal custody or care of any person under the age of 18 years is found to be in violation of § 133-3 hereof, shall, for the first offense, be given written notice of such violation, and for the second and subsequent offenses, such person shall be sentenced to pay of fine of not less than $10, and not more than $600 and costs, or in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days.
