In order to promote the development of affordable housing in Norfolk, and pursuant to Connecticut General States Section 8-19(b), the Town of Norfolk hereby exempts from the Norfolk Subdivision Regulations one division of a tract or parcel, provided that a lot created by the division is for affordable housing to be developed by the municipality or a nonprofit organization, subject to the following conditions and requirements.
A.
At least one lot so created shall be developed for affordable housing under Connecticut General Statutes Section 8-30g and shall be subject to the provisions set forth in that statute.
B.
Any further subdivision of a part or lot so created by this division shall not be exempt from the Subdivision Regulations.
C.
This exemption shall be in addition to any other exemption authorized under the Connecticut General Statutes and shall not be construed as exercising any right under any other exemption.
D.
The parts or lots created by this division shall comply with all applicable laws and regulations, including without limitation the Town of Norfolk Zoning and Inland Wetlands Regulations and the Connecticut Public Health Code.
E.
The landowner shall submit to the Zoning Enforcement Officer and shall record in the Norfolk Land Records an A-2 survey of the parts or lots created by this division that complies with the Subdivision Regulations and includes the following notation with respect to the lot created for affordable housing:
Lot ______ is restricted to use for a residential dwelling unit developed by the Town of Norfolk or a non-profit organization and qualifying as an affordable dwelling unit in accordance with the provisions of CGS Sec. 8-30g." |
