As used in this chapter, the following definitions shall apply:
MINOR
Any person under the age of 18 years.
PARENT
Any natural parent of a minor, a guardian or adult person 21 years of age or over who is responsible for the care and custody of a minor.
PUBLIC PLACE
Any public street, highway, road, alley, park, playground, public building or vacant lot.
REMAIN
To loiter, loaf, wander, stroll, or play in or upon, whether within or without or upon a vehicle.
From and after the passage of this chapter, the following shall constitute the establishment of curfew hours and certifications of employment:
A. 
No minor person shall be or remain upon any street, highway, alley, park, or public place within the Township after the hour of 11:00 p.m. and before the hour of 5:00 a.m. the following day, as measured by the prevailing time. Such restrictions shall be imposed unless the minor person is accompanied by his or her parent or is in the performance of employment for which he or she is receiving compensation or is returning from a recognized religious, educational or civic activity.

B. 
The Board of Commissioners is authorized to issue certifications of employment to employers of minor persons, which certifications shall be displayed by minors when such minors are in a public place during the hour of curfew restriction.
From and after the passage of this chapter, the following shall constitute the responsibility of parent or guardian: It shall be unlawful for any parent of a person under the age of 18 years to allow or permit such minor person to be in or remain upon any of the streets, highways, alleys, parks or public places within the Township after the hours mentioned in § 121-2 hereof.

It shall be the duty of every police officer of the Township, finding any minor person in or upon the public places within the Township as aforesaid, to take the name of such minor and the name and address of the parent(s) of the minor, to send the minor home or take other appropriate action and to make a report of the same within eight hours to the Chief of Police or his designee. A written notice of the violation, with due warning, shall thereupon be served or caused to be served by the Chief of Police or his designee on the parent(s) of the minor.
From and after the passage of this chapter, the following shall constitute the responsibility of minor: Nothing herein is intended to relieve the responsibility of the minor person in the enforcement of this chapter. Minor persons violating the provisions of this section shall be subject to the provisions of § 121-6B of this chapter.
A. 
From and after the passage of this chapter, the following shall constitute violations: If, after notice and warning, as provided in § 121-4 hereof, the minor is again found on or upon any of the streets, highways or public places in violation of this section, the parent(s) shall be proceeded against upon the complaint of the Chief of Police or appropriate police officer before the District Justice for the Township of Marple as provided in § 121-6B below.
B. 
From and after the passage of this chapter, the following shall constitute penalty: Should a minor person who is in violation of this chapter be between the age of 16 and 18, he or she, as well as his or her parent(s), shall upon conviction for such violation, be subject to a fine of not more than $600. Upon default in the payment of the fine and costs imposed upon such person, a notice of such fact shall be certified to the juvenile authorities of Delaware County.
