As used in this article, the following terms shall have the
meanings indicated:
REFUSE
All solid wastes of a community, including garbage, ashes,
and rubbish.

A. Refuse shall be placed in the sixty-four-gallon brown carts that
have been supplied to each unit. All solid waste shall be thoroughly
drained of water and wrapped securely and placed in bags before being
placed in the cart. All trash must be placed inside the cart. Solid
waste too bulk to fit into the cart shall be broken down so as to
fit in the cart, or may be securely tied in bundles not to exceed
50 pounds in weight or three feet in length and placed next to the
cart at the curb. Bulk items will be collected separately in accordance
with the then existing schedule as set forth by or as approved by
the Department of Public Works.
B. When not placed out for collection, refuse carts shall be stored
on the property, not within the alley, sidewalk, or other right-of-way.
Refuse carts shall be placed so as not to create a nuisance to other
residents or the public.
C. All public eating and drinking establishments, convenience and grocery
stores, and any other business that generates refuse shall provide
a trash receptacle in front of their establishments. Receptacles shall
be of a type and specification approved by the Municipality so as
to create uniformity. Said receptacles shall be kept clean and in
good repair. The operator of the business establishment shall be responsible
for disposing of the trash placed in the trash receptacles in front
of their establishments.
Household(s) shall place their refuse receptacles out for collection
at the appropriate location no earlier than 18 hours prior to the
regular collection time. Receptacles shall be removed from the collection
point and returned to an appropriate storage location no later than
18 hours after the collection time.
It shall be unlawful to burn or cause to be burned combustible
materials, refuse, garbage or any other materials whatsoever outside
an incinerator. Nothing in this section shall be construed to apply
to the usual use of barbecues or outside fireplaces for cooking food.
Any person who shall violate any provision of this article or
any regulation adopted hereunder, upon summary conviction according
to law, shall be punished by a fine of not less than $1,000. Each
day's failure to comply with any such provision shall constitute a
separate violation.
Fees shall be established from time to time by resolution of
Municipal Council.
