This chapter is adopted in order to protect the health, safety and well-being of persons and property by prohibiting certain animals within the Borough of Ho-Ho-Kus. The Borough Council of Ho-Ho-Kus finds that the harboring of certain animals within the Borough may be offensive to other residents so as to constitute a public nuisance and may pose a threat to the safety of its inhabitants and their property.
A. 
It shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control or to permit another to keep, maintain or have under his or her control within the Borough limits of the Borough of Ho-Ho-Kus any poisonous or constricting reptile or any other dangerous or carnivorous wild animal or reptile or any other animal or reptile of wild, vicious or dangerous propensities.
B. 
It shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the Borough limits of the Borough of Ho-Ho-Kus any of the following animals, including but not limited to all dangerous mammals and avian; all poisonous and constricting reptiles and animals, including vipers; boas; pythons; apes; arachnids; chimpanzees; gibbons; gorillas; orangutans; siamangs; baboons; bears; bison; bobcats; cheetahs; crocodilians; coyotes; elephants; gamecocks and other fighting birds; hippopotami; hyenas; jaguars; leopards; lions; lynx; monkeys (except those licensed for handicapped assistance); pumas, also known as "cougars," "mountain lions" and "panthers"; rhinoceroses; snow leopards; tigers; wolves; cattle bulls; elk; moose; wolverines; and badgers.
Any of the animals set forth in this chapter which have been kept, maintained, possessed or controlled by any person within the Borough limits of the Borough of Ho-Ho-Kus prior to the effective date of this chapter shall be grandfathered and exempt from the regulations herein. However, the owner or any person keeping, maintaining or having possession or control of such animal(s) must nevertheless register such animal(s) with the Animal Control Officer within 60 days from the effective date hereof. No offspring or replacement of such exempt animal(s) shall be entitled to a continued exemption.
The provisions of this chapter shall be enforced by the Animal Control Officer or any police officer of the Borough of Ho-Ho-Kus.
Any person who violates any provisions of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $1,000 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
