As used in this article, the following terms shall have the
meanings indicated:
ELIGIBLE MEMBER
Any individual whose name is carried on the active roster
of the Ho-Ho-Kus Volunteer Fire Department, was over the age of 45
when joining the Fire Department and is an active or life member.
In the event of the death of a member of the Ho-Ho-Kus Volunteer
Fire Department who is not entitled to and who has previously waived
the death benefit of the New Jersey State Firemen's Association, the
widow, or in lieu thereof, the estate of such deceased firefighter
shall be entitled to receive from the Borough of Ho-Ho-Kus an amount
equal to the amount of the prorated death benefit which would have
been provided by the New Jersey State Firemen's Association at the
time of the demise of an otherwise eligible member of the Ho-Ho-Kus
Volunteer Fire Department.
Any claim for payment of a death benefit shall be investigated
by the Ho-Ho-Kus Fire Department Relief Fund Rules Committee. A report
and recommendations, including the amount of the death benefit to
be paid, will be presented to the Mayor and Council for its final
determination.
