Upon the installation of street improvements by a developer and prior to final acceptance of the streets by the Township, the developer shall be responsible for the maintenance of the street, including, but not limited to, the removal of snow, ice and other obstructions from the street.
[Adopted 12-29-2003 by Ord. No. 2003-26]
By November 1 of each calendar year, the developer shall provide (in writing) the Township Clerk and Director of Public works with its name, address and phone numbers, and the name, address and phone numbers of the person or company engaged by the developer to perform services for the removal of snow, ice and other obstructions on said unaccepted streets.
Should the developer fail to remove snow, ice or other obstructions from an unaccepted street within its control after a reasonable period of time, the Township shall be authorized to remove snow, ice or any other obstructions from the unaccepted street, and said action shall not be considered an acceptance of the street within the developer's control. Except in the case of emergency representing an immediate threat to public health, safety or welfare as determined by the Director of Public Works, before undertaking the removal of snow, ice or other obstructions from an unaccepted street, the Township shall first attempt to contact the developer or the person or company engaged by the developer to perform services for the removal of snow, ice and other obstructions at a phone number provided by the developer.
Should the Township remove snow, ice or other obstructions from an unaccepted street, the developer of that street shall reimburse the Township for its costs in doing so at the rates of $0.25 per running foot of street for each plowing and $0.25 per running foot of street for each application of salt and/or sand to said street. The developer shall reimburse the Township for said costs within 10 days of the submission of a statement of costs to the developer. Should a developer fail to reimburse the Township for said costs, any additional costs incurred by the Township to obtain payment, including but not limited to legal fees, shall also be the responsibility of the developer.
Alternatively, the developer may, in lieu of performing services for the removal of snow, ice and other obstructions, directly request in writing the Township to perform said services at the same cost as set forth above.
