A. 
There is hereby established a residential parking permit program to be administered by the Police Department of the City of Burlington.
B. 
Pursuant to N.J.S.A. 39:4-197(f), the Common Council of the City of Burlington may by ordinance designate a residential area as eligible for a residential parking permit program.
C. 
The Police Department of the City of Burlington is hereby authorized to restrict parking on public streets in certain residential areas to vehicles displaying valid Residential area parking permits issued pursuant to this article.
D. 
This authority shall be in addition to and may be exercised in conjunction with any other authority that the Police Department of the City of Burlington may have to regulate parking.
As used in this article, the following words or terms shall have the meanings set forth below, except when the context clearly indicates a different meaning:
MOTOR VEHICLE
An automobile, truck, motorcycle or other motor-driven form of transportation.
RESIDENT
A person who occupies a dwelling unit within a residential area as his or her primary residence.
RESIDENT MOTOR VEHICLE
A New Jersey registered motor vehicle owned or leased by a resident of a residential permit parking zone.
RESIDENTIAL PERMIT PARKING ZONE
A residential area designated as herein provided, where resident motor vehicles displaying a valid residential area parking permit shall be exempt from certain parking restrictions established under this chapter.
A. 
The Common Council of the City of Burlington may, by ordinance, designate or eliminate a residential area as eligible for the residential parking permit program.
B. 
The Police Department of the City of Burlington shall issue a residential area parking permit for a resident of a designated residential permit parking zone upon application and payment of the applicable fee.
(1) 
The Police Department will investigate each applicant to determine if he or she qualifies.
(2) 
A person eligible to apply for a residential parking permit owns or operates a motor vehicle and resides on property immediately adjacent to a street, avenue or other location selected for implementation within the residential parking zone.
(3) 
Proof of residency in a residential permit parking zone on a block designated for implementation must be presented at the time the application is made.
(4) 
The application for a residential area parking permit shall contain the name of the owner or operator of the motor vehicle, residential address, the make, the model, registration and plate number of the motor vehicle and the number of the driver's license of the applicant.
(5) 
The motor vehicle registration and the driver's license of the applicant must be presented at the time of making application in order to verify the contents thereof.
(6) 
The owner or operator of any motor vehicle applying for a residential area parking permit shall have a valid New Jersey State motor vehicle license.
(7) 
The owner or operator of any motor vehicle applying for a residential area parking permit shall have a valid New Jersey State motor vehicle inspection tag displayed on said motor vehicle.
(8) 
Residential area parking permits will be issued only to the vehicle described and to the person named on the application.
(9) 
No more than one parking residential area parking permit shall be issued to any residence or household.
(10) 
Residential area parking permits are not transferable.
(11) 
All residential area parking permits will be issued by a registration number and shall be valid and in effect during the year that said residential area parking permit is issued, and for the year immediately following.
C. 
The Police Department of the City of Burlington or its designee shall install parking signs on the streets designated as residential permit parking zones. The signs shall indicate the times, locations and conditions under which parking shall be by residential area parking permit only.
A. 
Notwithstanding any provisions of this chapter to the contrary, the holder of a residential area parking permit shall be permitted to stand or park a motor vehicle for which a residential area parking permit has been issued in the residential permit parking zone designated on the residential area parking permit without being subject to the limitations imposed on vehicles lacking the residential area parking permit; provided, however, that how, where and when such vehicle is parked, such parking is otherwise not prohibited.
B. 
While a motor vehicle for which a residential area parking permit has been issued is so parked, such residential area parking permit shall be displayed so as to be clearly visible through the windshield of the vehicle.
C. 
A residential area parking permit shall not authorize the holder thereof to stand or park a motor vehicle in such places or during such times as the stopping, standing or parking of motor vehicles is prohibited or set aside for specific types of vehicles.
D. 
A residential area parking permit shall not exempt the holder from the observance of any traffic regulations other than the residential permit parking limitations.
E. 
A residential area parking permit shall not guarantee to the holder hereof a reserved on-street parking space within the designated residential parking permit residential permit parking zone.
A. 
Police and emergency vehicles shall be exempt from holding a residential area parking permit and exempt from posted time limits.
B. 
Service vehicles parked in a residential permit parking zone while making service calls to residential dwellings within a residential permit parking zone shall be exempt from displaying a residential area parking permit if such service vehicles display, in the windshield on the passenger-side of the vehicle, a work slip, or other document clearly showing the same address of the residence being serviced.
C. 
Handicapped parking places designated by statute as assigned to a specific household shall take precedence over this article when a conflict exists between the statute and this article, such that an otherwise lawfully designated handicapped parking place will not be removed by any action taken under this article.
D. 
In a residential permit parking zone, a resident of a residential permit parking zone who does not own a motor vehicle, but who is otherwise eligible to receive a residential area parking permit, may apply for a temporary visitor's residential area parking permit.
(1) 
A temporary visitor's residential area parking permit shall be a portable permit that will exempt the motor vehicle in which it is displayed from the residential parking prohibitions set forth in this chapter to the same extent as would a permanent residential parking permit.
(2) 
The portable visitor's permit shall be valid for two years from the date of issuance.
(3) 
The portable visitor's permit shall not be transferable from the person to whom it was issued to any other person.

A. 
Display of residential area residential area parking permits. Such residential area parking permit must be displayed at all times upon the inside rear view mirror of the motor vehicle being parked as permitted herein so that the same shall be visible from the outside of such vehicle.
B. 
Any person parking a motor vehicle not displaying a valid residential area parking permit which has been issued in accordance with the provisions of this article and who parks such vehicle in a residential permit parking zone where signs are erected during the posted hours of operation of a residential permit parking zone shall be subject to receipt of a notice of violation and the imposition of a monetary fine or imprisonment for not more than 15 days, or both, for each violation and impoundment in accordance with applicable provisions of the City Code. Any person convicted of a first offense under this section shall be subject to a minimum fine of $84 payable through the City Violations Bureau.
C. 
Any vehicle parked in a residential permit parking zone in violation of any provision of this chapter requiring immediate removal and impoundment or which is found to be causing a severe hazard to traffic or public safety shall be subject to such action without regard to display of valid residential area parking permit.
D. 
No person other than the permittee named thereon shall use a residential area parking permit or display it on a vehicle operated or parked. Any such use or display by a person other than the permittee shall constitute a violation of this article by the permittee and by the person who uses or displays such a parking residential area parking permit.
E. 
It shall constitute a violation of this article for any person to falsely represent himself as eligible for a residential area parking permit.
F. 
It shall constitute a violation of this article for any person to furnish willfully false information on an application to the Police Department of the City of Burlington in order to obtain a residential area parking permit.
G. 
The Police Department of the City of Burlington is authorized to revoke the residential area parking permit of any permitted found to be in violation of this article for misrepresentation or illegal use of a residential area parking permit.
H. 
Upon written notification thereof, the permittee shall surrender such residential area parking permit to the Police Department of the City of Burlington.
A. 
The Common Council of the City of Burlington is authorized by resolution to establish a residential area parking permit fee for such residential parking zones to cover the administrative cost of the residential area parking permit program pursuant to this article.
B. 
The fee must be submitted to the Police Department of the City of Burlington for approval.
C. 
All residential area parking permits will be issued by the Chief of Police free of charge.
D. 
The City will not be responsible for lost or stolen residential area parking permits, and the cost of replacement is $5.
The Common Council of the City of Burlington hereby designates the following residential permit parking zones for a residential parking permit residential permit parking zone:
A. 
Pearl Boulevard.
(1) 
Pearl Boulevard and Block 115, Lot 7. Block 115, Lot 7 is hereby designated for the use of 216, 218 220 and 222 Pearl Boulevard in accordance with the sketch below.
(2) 
The Chief of Police shall designate one on-street parking space in front of and for the use of 228, 230, and 232 Pearl Boulevard, in accordance with the sketch below, which sketch is incorporated herein by reference.
B. 
Stacy Court (Block 117, Lot 2). Block 117, Lot 2 is hereby designated for the use of the residents of Stacy Court and their visitors in accordance with the sketch below, which sketch is incorporated herein by reference.
C. 
Mitchell Court (Block 151, Lot 44). Block 151, Lot 44 is hereby designated for the use of the residents of Mitchell Court and their visitors in accordance with the sketch below, which sketch is incorporated herein by reference.
