The Manager shall be chosen by vote of a majority of all members of the Council. The Manager shall be a person, other than a member of the Borough Council, fully qualified to exercise the powers and perform the duties enumerated in this chapter and the general laws of the State of New Jersey. He need not be a resident of the Borough at the time of his appointment but shall become a resident thereof within three months after appointment and continue a resident throughout his period of service; provided, however, the Borough Manager may reside outside of the Borough with the approval of the Borough Council.
The Borough Manager shall hold office as long as he shall perform the duties of his office to the satisfaction of the Borough Council. The term of such Manager shall be indefinite, and he may be removed by a majority vote of the Council in the following manner: The dismissal of the Manager may be effectuated by the adoption by the Council of a preliminary resolution stating the reasons for its removal action by a majority vote of the Council members. The Manager may reply in writing to the resolution and may request a public hearing on the matter of his removal, which shall be held not earlier than 20 days and not later than 30 days after the filing of the request. After the public hearing, if one be requested, and after full consideration, but not later than 60 days after the adoption of the preliminary resolution of removal, the Council by a majority vote of its members may adopt a final resolution of removal. In such case, removal shall take effect immediately. Upon the adoption of the preliminary resolution of removal, the Council may suspend a Manager from duty and shall pay the Manager his full salary during his suspension and, if a final resolution of removal is adopted, for the next three calendar months following the adoption of the preliminary resolution of removal, unless the removal is for good cause. Good cause shall mean conviction of a crime or offense involving moral turpitude, the violation of the provisions of N.J.S.A. 40:83-2, 40:83-3 or 40:83-4 or the violation of any code of ethics applicable in the Borough.
The Council shall appoint a properly qualified person to perform the duties of the Manager during his absence or disability and until he shall return or his disability shall cease.
The Manager shall:
A.
Be the chief executive officer and administrative official of the municipality with all the power and authority as set forth herein or otherwise provided by law.

B.
Compile and submit to the Borough Council the tentative annual budget.
C.
Execute all laws and ordinances of the Borough.
D.
Appoint and remove all department heads and all other officers, subordinates and assistants for whose selection or removal no other method is provided by law, supervise and control his appointees and report all appointments or removals at the next meeting thereafter of the Council.
E.
Subject to the Charter, direct and supervise the various departments through the department heads or otherwise.
F.
Attend all meetings of the Council with the right to take part in the discussions but without the right to vote.
G.
Investigate at any time the affairs of any officer or department of the Borough government.
H.
Negotiate contracts for the Borough subject to the approval of the Council, make recommendations concerning the nature and location of Borough improvements, and execute public improvements as determined by the Council.
I.
Supervise the investments and invested funds of the Borough or in possession of the Borough in a fiduciary capacity, except as otherwise provided by law, and keep such investments and invested funds safely invested pursuant to law.
J.
Examine, review and approve all expenditures and financial commitments of the Borough government, and no such expenditure or commitment shall be authorized without such approval.
K.
Study the operation, efficiency and control of departments, functions and activities supported by Borough funds, and make recommendations to the Council from time to time for the improvement thereof, as need appears.
L.
See that all terms and conditions imposed in favor of the Borough or its inhabitants in any statute, contract or public utility franchise are faithfully kept and performed and, upon knowledge of any violation thereof, call same to the attention of the Council.
M.
Recommend to the Council for adoption such measures as he may deem necessary or expedient, keep the Council advised of the financial condition of the municipality, make reports to the Council as requested by it and at least once a year, make an annual report of the administration of the Borough government for the benefit of the Council and the public.
N.
Operate and maintain a central switchboard for telephone service to all Borough offices other than the Police Department and a central duplicating service for various offices.
O.
Perform such other duties as may be required of the Manager by the Charter or any ordinance or resolution of the Council.
P.
Act as purchasing agent for the municipality.

The Manager shall appoint and may remove department heads, subject to the Charter. Whenever he deems it necessary or desirable, the Manager may appoint an officer or employee of a department to serve temporarily as acting head of a department. With the approval of Council, the Manager may designate himself as acting head of one or more departments, without additional compensation.
The Manager may, in his discretion, allocate, assign or delegate functions or powers to a department head for more efficient administration of the Borough government, provided that any such delegation, allocation or assignment shall not relieve the Manager of any of his responsibilities under the Charter or this chapter, nor shall it be inconsistent with any express requirement of the Charter or this chapter or any other applicable general law. Any such delegation shall be in writing and shall be promptly reported to the Council and recorded in its minutes.
A.
The Manager shall have custody, management and control of all Borough property which is not otherwise allocated or assigned to a department or other official by either this chapter or any other general law.
B.
The Manager, with the approval of the Council, shall arrange for such insurance and suretyship coverage as may be required by the Borough to protect it against risks of loss from whatever cause. All insurance policies and official surety bonds shall be filed for safekeeping with the Clerk.
