GENERAL REFERENCES
Zoning — See Ch. 585.
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
An individual, proprietorship, partnership, corporation, association or other legal entity.
SEXUALLY ORIENTED BUSINESS
A. 
A commercial establishment which as one of its principal business purposes offers for sale, rental or display any of the following:
(1) 
Books, magazines, periodicals or other printed material or photographs, films, motion pictures, video cassettes, DVDs, video CDs, slides or other visual representations which depict or describe a specified sexual activity or specified anatomical area, or still or motion pictures, machines, projectors or other image-producing devices which show images to one person per machine at any one time, and where the images so displayed are characterized by the depiction of a specified sexual activity or specified anatomical area, or instruments, devices or paraphernalia which are designed for use in connection with a specified sexual activity.
B. 
Moreover, a sexually oriented business shall also include a commercial establishment which regularly features live performances characterized by the exposure of a specified anatomical area or by a specified sexual activity or which features exotic or erotic performances, including dancing of the style known and referred to as "go-go" dancing, "pole" dancing, "table" dancing and/or "lap" dancing, or which commercial establishment regularly shows films, motion pictures, video cassettes, video CDs, DVDs, slides or other photographic representations which depict or describe a sexually oriented activity or specified anatomical area.
SPECIFIED ANATOMICAL AREA
Less than completely and/or opaquely covered human genitals, pubic region, buttock or female breast(s) below a point immediately above the top of the areola, or human male genitals in a discernibly turgid state, whether or not covered.
SPECIFIED SEXUAL ACTIVITY
The fondling or other erotic touching of covered or uncovered human genitals, pubic region, buttock or female breast(s) and/or any actual or simulated act of human masturbation, sexual intercourse or deviate sexual intercourse.
It is recognized by the Mayor and Council of the Borough of Lodi and documented by numerous expert studies and reports throughout the country that sexually oriented businesses, because of their very nature, have serious objectionable operational characteristics that result in a deleterious effect upon adjacent areas. Special regulation of these uses is thus necessary to ensure that these adverse consequences will not contribute to the blighting or downgrading of the surrounding neighborhoods or general business districts. As a result of the foregoing, the Mayor and Council of the Borough of Lodi are desirous of establishing a zoning district wherein the typical characteristics attached to sexually oriented businesses are unlikely to result in the adverse impact described herein.
Sexually oriented businesses shall be a permitted use within the Borough's Industrial Zone located along the New Jersey Highway 17 corridor, and expressly limited to properties known and designated as Block 184.01, Lot 2; Block 184.01, Lot 3; Block 177.02, Lot 2.01; Block 177.02, Lot 2.02; Block 177.02, Lot 2.03; Block 177.02, Lot 2.05; Block 224, Lot 3 and Block 224, Lot 3.06.
Subsequent to the establishment of the zoning district created hereby, and upon the receipt of recommendations from the Planning Board of the Borough of Lodi, the Mayor and Council shall adopt bulk requirements and buffering standard applicable to the within zoning district. However, be it here established that, in addition to any and all bulk and buffering requirements recommended by the Planning Board of the Borough of Lodi, no sexually oriented business establishment shall be permitted to be located within 500 feet of another sexually oriented business establishment.
