There shall be a Local Emergency Planning Council of no more
than 15 members, in the discretion of the appointing authority.

All members of the Council shall be appointed by the Manager
for a term as provided by N.J.S.A. App. A:9-33 et seq. and other laws,
executive orders, rules, and regulations.

The Council shall have such powers and duties and functions
prescribed by N.J.S.A. App. A:9-41, by general law, executive order,
ordinance and resolution. The Chairperson of the Council shall be
the Municipal Disaster Control Director.

The Local Emergency Planning Council shall be the designated
emergency management control agency or other designated controlling
agency under the following laws, regulations and resolutions:
(a) Federal: Federal Civil Defense Act of 1950, as amended; the National Disaster Recovery Act of 1969, as amended;
the Robert T. Stafford Disaster Relief Act of 1974, as amended.
(b) State: Emergency powers of the Governor, N.J.S.A. App. A:9-30 et
seq.; the emergency provisions of N.J.S.A. 40A:14-26 relating to police
and fire protection to other municipalities; Office of Emergency Management
Directives Nos. 61, 73, 74, 77, 84, 96, 100, 101, 102, 103 and 104.
(c) County: Resolution No. 86-83, establishing the Bergen County Office
of Emergency Management; Ordinance No. 88-25, establishing procedures
for management of hazardous materials incidents.
