It is hereby determined following investigation and reports by state, county and City authorities that the great increase in the number of uncontrolled pigeons, which roost and make their nests on the roofs and in the recesses of the various public and private buildings and structures within the City, constitutes a menace to the public health and is generally injurious to property within said City.

For control purposes and in order to prevent public distress caused by the pigeon menace described in § 74-24, the Common Council of the City is hereby authorized to issue permits for the purpose of trapping pigeons within the City, in accordance with the provisions of § 11-0513 of the Environmental Conservation Law and any regulations established by the Common Council.

A. 
Generally. Any pigeon or pigeons found in any of the traps set up, placed or permitted to be placed for trapping purposes shall, if the same be fit for such purposes, be disposed of for food purposes within the meaning of § 11-0513 of the Environmental Conservation Law. All sick, injured or unfit pigeons found in the said traps shall be placed in the care of the Common Council to be disposed of in the manner provided by law.
B. 
Antwerp or homing pigeons. Whenever any Antwerp or homing pigeon, wearing a ring or seamless leg band with its registered number stamped thereon, within the meaning of § 11-0513 of the Environmental Conservation Law, is found among such trapped pigeons the same shall be immediately released from custody.
